Advice on returning toy

I bought a toy castle for ds from Toysrus. It was missing the entire back wall!

I'm going to return it tomorrow. Can I demand a refund as it wasn't of merchantable quality, or do I have to accept a replacement/gift vouchers?

TBH, I'd rather take my custom elsewhere, if I can

Any ideas?
(poor ds was so good about it, bless him, but he was very disapointed)

As it's not fit for the purpose it was intended for then you should be entitled to a refund.

Thanks for that, I'll have a look in the ELC and see if they have any castles left. Ds also has some ELC vouchers to add to the knights I got him, we can get them all at he same time

yes you can DEMAND a refund!

its not of merchandisable quality.

Im sure a place like Toys R us wouldnt argue with that anyway!

Got a replacement which I was reasonbaly happy with.

Guess who will not be getting my custom again?
