OMG Had phone call from Solicitor regarding our house purchase...

.... and they have informed us that the offer we put in on the house has not yet been accepted properly!
I didn't even realise that could happen in Scotland, but they accepted the offer in principal on 3rd November....... and haven't got back since!

She said and I quote "I'm sure its nothing to worry about..... I don't think there's anything untoward. They've probably just overlooked it!"

WTF? My Solicitor should have chased this up 2 weeks ago, but the person dealing with it left and someone else has only just picked it up!

What am I going to do??? We are supposed to move in on 27th January. Our house sale is finalised all but the signing of the missives..... and our mortgage is just about to be approved.

What if the sellers back out??? Where the feck will we live from January 27th? We'll never have time to find somewhere else.

Anyone know Scottish law that can help?

GOMEZ??? Anyone? This is all I need.

Oh and where to we stand with regard to the Solicitor overlooking the time limit? We'd have had much more time if they had chased it up when they should have..... now we could be left high and dry if they back out.

Oh bugger. I have no idea where you stand, but I'd be making sure (in a calm and firm voice, save the shouting for when they've done the work ) that your solicitors put you as top top top priority now.

OMG CHilly - Thats exactly what we're buying. A 4 bedroomed detached. We offered 145k. But we need to buy in Falkirk coz DH works in Alloa, I work in Glasgow (travel by train, don't drive) and the kids are in Nursery at Falkirk stadium!

However....if things go pearshaped we might be looking elsewhere!

There is a train station right at the end of the road - Is on the Edinburgh to Glasgow line! the only thing is no nurseries in that area

Followthestarlover - we have just moved back down south & will just be able to afford a 3 bed semi!

Yes after that I'm being a bit fussy as our 1st house was a mid terrace I don't really want to go back to that so I am hoping for a semi but the noice we make might send the neighbours away!!

Chilly - I would LOVE to say I'd go for it. But Motherwell is an area that I just don't know.... and we really need a nursery for ds(4.5) and dd(16mths). Plus my Mum looks after them 1 day a week to keep our costs down and she lives in Stirling.

Are you having trouble selling it? At that price I'd be really surprised!

Yes it has been on the market since April

we haven't lived in it since May and seem to be throwing money down the drain especially as we keep lowering the price

We did have a buyer in August they put the offer in with a condition that we completed within 12 weeks it turned out they hadn't sold theirs & it is in a slow selling area so was v annoyed with that as it went off the market for weeks

Although one of the neighbours is doing a second veiwing on it tomorrow with their parents so fingers crossed!

However.... sure;y it must count for something that the house we're supposed to be buying has been taken off the market and has a SOLD sign outside!? Unless...... oh god please no....... they couldn't have sold it to someone else could they??????

Have the solicitors had any correspondance?

Our solicitor up there left & someone else took over but as I workfor solicitors down here I know what they are like & phone them at least once a week just to find out if our original buyers had sold theirs!

we are now even thinking of moving back up - if dh wasn't so fussy about jobs we probably would - I had a good nursery up there so I don't know if I would get the kids back in there & I wouldn't have a problem finding a job I just don't want to move from my family again

If you don't get much out of your solicitor ask to speak to a partner - they should get on the case for you.

Has the survey & searches been done?

I'm not sure if it the same up there - down here we have local searches, drainage searches etc done it picks up if anyone has put in planning permision for anything just so that you know that a nuclear power stainisn't going to pop up on your doorstep!

I can't remember if they did ot when we bought ours but as they were the brand new ones they may have done it for the whole estate as I know that that is what our solicitors were planning to do to get recomendatiosn from local new builds

SackAche, from my limited knowledge (ex legal secretary, in Scotland) I wouldn't panic too much about a deadline being missed, the deadlines in the missives aren't really worth the paper they are written on, the other side will reply and "delete" the time limit. However I would get on your solicitor's case as it is not on that your original solicitor left and they have not done anything. Plenty of time to complete before the 27th if everyone gets their finger out now.
