OMG Had phone call from Solicitor regarding our house purchase...

.... and they have informed us that the offer we put in on the house has not yet been accepted properly!
I didn't even realise that could happen in Scotland, but they accepted the offer in principal on 3rd November....... and haven't got back since!

She said and I quote "I'm sure its nothing to worry about..... I don't think there's anything untoward. They've probably just overlooked it!"

WTF? My Solicitor should have chased this up 2 weeks ago, but the person dealing with it left and someone else has only just picked it up!

What am I going to do??? We are supposed to move in on 27th January. Our house sale is finalised all but the signing of the missives..... and our mortgage is just about to be approved.

What if the sellers back out??? Where the feck will we live from January 27th? We'll never have time to find somewhere else.

Anyone know Scottish law that can help?

GOMEZ??? Anyone? This is all I need.

Well..... apparently the people whose house I'm supposed to be buying have now purchased somewhere else..... and they are trying to tie up moving in dates!

SO PHEW!!! They're not backing out....

BUT they will probably propose another date. I don't feckin care as long as I get the missives signed!

I would also ring the sellers directly often they have no idea whats going on and are as much in the dark as you?

DId you agree a timescale of missive completion?

And do your buyers have flexibility in their entry date?

But all in all not too bad - right I am away to pack!

Buyers both still live with their Mummy and Daddy so will have a dgree of flexibility!

I've got to phone on Monday to agree dates about missives. The ones for my house are nearly ready.

NOW GO PACK GOMEZ!

Another update!!!

Phoned Solicitor and instructed them to inform the sellers Solicitor that unless they accept my offer in writing by COB Wednesday 14th December..... then my offer would be withdrawn.

Letter faxed at 10am.

3pm STILL nothing!

So I phone the Estate Agent and ask them to pass my work number onto the Sellers. 30 mins later I get a phone call from the Estate Agent: They phoned the buyers Solicitor and asked if they were aware that nothing had yet been sent and that it was getting crucial. The Solicitor simply said "er...yes". So EA phoned the owners Mr & Mrs A. They were horrified! Had NO idea that there was any problem. As far as they are concerned things are ticking over nicely!

They are going to get on the phone to their Solicitor ASAP to get this sorted!

Now... I have a problem....

WHAT IF their Solicitor is so useless that they still don't have anything to my Solicitor by the deadline?????? My offer will automatically be withdrawn right????

Now that Mr and Mrs A know what is going on they will get on to their sols I'm sure.

Do you now have direct contact with Mr and Mrs A? If so I would try and phone them as it will probably put your mind at rest to hear them being positive about the transaction still going ahead.

I wouldn't panic too much about there being no response by 3pm today when the letter was faxed at 10am this morning, it's unbelievable how long a letter can take from a solicitor and will no doubt need chased on Wednesday.

Right....another problem!

Solicitor just called today so say that I've got to have the missives signed by tomorrow or they are putting the house back on the market!!!!

I'm on the phone to Halifax right now as they were supposed to phone me on TUESDAY with the YES NO decision on my mortgage.

Now I'm being told that due to a technical error at their end they can't get me a final decision yet! BUT IU've not to worry as thjey have logged a technical fault with the helpdesk!

Yeee-bloody-ha! I'm seething, he's away to speak to his Manager!

Shower of wankers the lot of them.

No not really. He's going to phone me back after his Manager has contacted the Head Office tonight. They have me over a barrel though.... I can't go elsewhere at such short notice!!!!!
