OMG Had phone call from Solicitor regarding our house purchase...

.... and they have informed us that the offer we put in on the house has not yet been accepted properly!
I didn't even realise that could happen in Scotland, but they accepted the offer in principal on 3rd November....... and haven't got back since!

She said and I quote "I'm sure its nothing to worry about..... I don't think there's anything untoward. They've probably just overlooked it!"

WTF? My Solicitor should have chased this up 2 weeks ago, but the person dealing with it left and someone else has only just picked it up!

What am I going to do??? We are supposed to move in on 27th January. Our house sale is finalised all but the signing of the missives..... and our mortgage is just about to be approved.

What if the sellers back out??? Where the feck will we live from January 27th? We'll never have time to find somewhere else.

Anyone know Scottish law that can help?

GOMEZ??? Anyone? This is all I need.

Toothy if you can afford a mortgage then of course you can afford to rent in the short-term. You will also have the equity from the sale of your house. Not ideal but not the street either.

Until you complete missives then you can walk away at any point - there is no legally binding deal in place. Your solicitor may not be too chuffed but he must do as you instruct. Then again he might not give a toss - they are all different.

I rent so havent a CLUE but whats stopping you from nipping round and saying Hi Mr and Mrs X my solicitors having trouble getting hold of your whats the score here?

Or is it not allowed/that simple?

Gomez - The Solicitor can't really complain. Its the same woman dealing with my sale and purchase. She should've been chasing this up since the 10th November! The house nextdoor was still on the market then and the guy was desperate to sell as he had a bridging loan. So it's my Solicitors incompetance that is adding to the problems.

I won't do anything until I speak to the Solicitor this afternoon.... and get the bad news.

So go round thinking that and compose yourself and then they might have NO IDEA whats going on and say...everythings fine...

Sackache - I think Charlie's idea is a good one. Try and speak to the sellers (if you can) - perhaps it isn't them, just that their solicitor is crap.

SachAche - have just checked with one of our fee earners you can go and talk to the sleer direct it is the solicitors that can only talk to each other & their own clients so if your solicitor doesn't have anything firm to tell you I would go round & see them.

For all you know the sellers solicitor is having problems getting hold of their client.

Think positive everything will turn out ok (I keep telling myself that anyway!)

Our solicitors don't have secretaries - and I wouldn't say we were modern day!!!

Its Russell & Aitken. They don't have Secretaries, just a main reception area. Its the receptionist I've been speaking to.

I used to work in a Solicitors pratice and secretaries were slowly phased out in favour of large typing pools. Gone are the days when Effie and her manual typewriter knew everything - more is the pity.
