Sky charging me twice for two years and will not refund the money, advice please.

We moved home in December 2008, sky contract was in my name. Phoned to move service to new address advised by sky to set up a new contract in DPs name to take advantage of new customer offer, they would cancel old contract.

Roll on two years (December 2010) and l notice from our direct debit account that two payments of £23.00 per month are coming from the account. l enquire and find we have been paying for our old house for 24 months ! thats just over £500.

We actually know the new owners and they confirm they set up their own sky contract when they moved in after we left. So no -one has been enjoying the service i have been paying for. More worrying sky did not notice they had two contracts and two payments being made from the sale sole property.

I have spoken to them and cancelled the direct debit. They would not agree to a refund over the phone, claiming you have no proof you cancelled your old contract, and we have no record of it on our 'system'.

l have followed their complaint procedure, and have written to them explaining the situation. You cannot actually speak to anyone in their scotland based customer services unit it has to be by letter. l have written twice and have been told bluntly twice they do not consider l should have either a refund or credit.

If l could cancel my current contract l would, but there are no alternative suppliers.

l know we should have kept a better eye on our bank account and cancelled the direct debit ourselves, but in my defence the payments where not together, one was at the end and one at the beginning of the month.

l have requested some application forms from the small claims court. Anyone any advice or experience of similar.

you do have proof you moved house

you took the new contract in your dh name on their own advice

send them a letter saying you are taking them to the small claims courts - which you can do for this smaller amount yourself

I doubt they will show up over this amount and they are trying it on....

go to these people first as small claims is last resort- so if this doesn't work then small claims and you can then show you have tryed agian to resolve this

Thanks Ivy. l have spoken to Consumer Direct who passed me on to OTELO, but they only deal with issues relating to telecommunications 'bundles' ie. internet, phone and TV in one contract, and not just TV contracts like me ?

In my letter(s) l have mentioned to sky l have consulted these two bodies and that without some resolution l will take some legal action, so l am kind of where you suggest. No further l can go without taking them to small claims court.

The paperwork arrived yesterday, for around £60 l think l will give it a go, like you l think for the sake of sending someone they will hopefully reconsider the refund. Only concern l have is whether it has to be heard nearest to the defendant or myself, l live on south coast and their customer services are based on scotland. Thanks again

It's not usually 'heard' - it is just dealt with at Northampton. You won't have to go there and neither will they. It's all done by paperwork.

email the CEO. we had a problem with sky and after e mail was sent everything was sorted very quickly.

Send a letter to the CEO at the Osterley headquarters. The letters are logged and then fast tracked to the correct department to deal with. Follow up with as many phone calls as you can fit in to your daily routine and ask to be put through to the CEO's office (explain you have written with a complaint)!! Then ask what they are doing about your problem!

They will sort it. Smile

Hi my husband died if cancer recently sky was cancelled till I moved to a new house but owe me 4 thousand due to takeing 3 lots if payments monthly for years we are elderly I dudnt know till my son looked at are finances when my hubby died obviously he was to ill to realise and I didn't know they said I didn't cancel but I did also they can tell by electrical roll they must do this to a lote of people they are making money of my dead husbands back who worked hard all is life till he become terminally they hve had the money they shld be made to pay back jst getting you know yre not alone something shld be done abought their scams
