Baliffs - what can they do?

Mytwopenceworth · 06/10/2005 13:26

Does anyone know a good site about what baliffs can and can't take?

eg can they take kids toys, or the computer if it is used for work and without it you would not be able to earn a living?

Can they take your car if you need it cos your kids are disabled and without it you wouldnt be able to get them to all their appts or take them anywhere?

can they come back several times in case you have replaced what they took?

Can they break into your house when you are out if you leave a window open for example?

Can they climb over your gate to get into your garden if the gate is locked?

and other daft questions!!

No idea! Are you in this situation???

I'm in Scotland and the only time Bailiffs can ever take stuff from your house is if you haven't paid your Council Tax.

edam · 06/10/2005 13:34

Suggest you call the citzen's advice bureau - they will know and it is free. Bailiffs can't enter your house without permission unless they have a warrant granted by a court. So unless you have been to court, they can't come in unless you let them in. If this is the result of a court case, call the court and they will tell you - clerk is usually helpful.

Pretty sure that they can take all of the things that you mention, and can climb over your gate, but wouldn't think that they can break into your house.

Note that they might have got the warrant from court without you attending, so just because you haven't been doesn't mean that they can't take stuff.

munz · 06/10/2005 13:44

I didn't think they could come in unless u said OK, and didn't think they could take the things u need - ie/ cooker, fridge washer etc esp if u have children - would have thought they'd only take things of value.
