Advice re: refund please

Long story short...

On 13th Dec 2010 DH and I agreed to PX our car in return for a cheaper one with a local garage. Difference was £5500 which they agreed to pay us for our car.

They said they'd arrange for the new car to valeted and MOT'd again and they'd call when it was ready. Basically, 4 weeks on, it still isn't ready and we have heard every excuse under the sun with regard for the reason to this.

We paid £100 deposit at the time and despite saying they would not cash it (just hold it until the sale went through) they did.

Now we have had enough and want to walk away from the deal. The original Order Form wasn't signed by us (wasn't done on purpose), so I wondered where we stood with asking for the deposit back.

I find people more cooperative face to face and would therefore visit the manager of the local garage and demand to see the cheaper car you were offered. If they can't produce it (and I strongly suspect they won't be able to) then you have been offered something that doesn't exist and I think you can legitimately demand your £100 back.

I have spoken to them today and they agreed to refund me. I don't understand what they had to gain from this though?

Sounds to me like they've messed up. Maybe the car you were expecting got sold to someone else? A better garage would have owned up if there was a problem and offered you a different car. Glad you got your money back.
