miscarriage and sick leave?

I'm sure I read on here that miscarriage classes as maternity sick leave, rather than adding on to your normal sickness absence record.

Can anyone confirm whether this is the case? I can't find anything online to back it up. My current employer states that it will go on my record as a normal sickness absence. It's making me feel very anxious about having any time off!

Hi, certainly in the nhs it is classed as pregnancy related and so to that end it is not counted in sick leave.
Not sure about employment law and policy outside of the nhs.

It is pregnancy related and therefore should not be counted as sick leave. My time off was never counted.

Miscarriage is counted as pregnancy related sick leave and cannot be counted as normal sick leave, in that you can not be disciplined for it.

It does however get taken out of normal sick leave entitlement so if you only have 20 days a year for example and go over, you would only get statutory.

But it cannot be counted "against" you or used in a total sickness record, as this would be discrimination.

Your HR department need to learn how to do their jobs properly.

For the record, I've had 3 mc's in the last year and it has never been an issue

Thanks for your replies everyone! Assume they must just mean it gets deducted from my normal sick leave allowance when they say it counts as normal sick leave.

Wow this is helpful, I am on level 2 sickness monitoring and half the time I was off due to my pregnancy and some for my mc then some due to abdominal pains which I think is because of my mc so am I able to do something about this ??

Hi babyangel you might need a doctor to confirm the stomach pains as to do with your mc as the point is, you could've had those whilst not pregnant (just playing devils advocate) but your mc absolutely cannot count against your overall sickness record as it counts as pregnancy related illness.

For example if you had a cold whilst pregnant that does count against your sickness record as you could've had a cold whilst not pregnant if you see what I mean? It's not a direct result of being pregnant. Same as morning sickness can't be counted.

You need to read gov.uk for all your rights. But this is basic HR and companies should know better !!!!! Angry

I recently had a mmc, and was tod that although the time I had off was 'sick' leave and was classified as such, that it would not be counted as sick leave in the event of re-organisation/making people redundant.

So I would get the pay, etc, that I was entitled to but it wouldn't be included in my sick leave tally, iyswim.
