unmarried father named on the birth cert+passport question....

i wasn't married to my x(thankfully). My children did have uk passports and then I returned to my home country. My solicitor advised me to return the UK passports and sort out Irish ones, which I did. I had to get an affadavit signed to bring to the police along with passport application, but it was straightforward enough.

now i'm wondering, could my x apply for uk passports for my children again?? we weren't married but he would be the automatic joint guardian of the younger one because dc2 born in 2006.

do i need to worry about this. (i do continually live with low level fear that he'll grab the kids and go and live in australia or somewhere)

ChoreDodger....where in Ireland are you from?

I'm probably teaching a granny to suck eggs but if you, your parents or grandparents were born in the 6 counties YOU are entitled to Dual Citizenship and therefore so are your children....you would be able to apply for the British passports yourself.

I think if he has PR and a UK passport himself then he can apply for the younger one. Technically, to take a child out of the country you need permission from all those people with PR (ie he'd need to ask you to take them to Australia, you needed to ask him to take them to Ireland).

As for whether you need to worry about it, really only you can know that.

We are not married and we applied for a uk paasport for ds last month

The form only had a space for one parent's details and it was dp' name that was on it

It came back saying because there was no marriage details that dp had to provide one of the following

  1. an adoption certificate
  2. a custody order
  3. A letter from me approving the passport application

so your ex could apply but wouldnt get it without coming through you

FraserMummy ... was that a UK passport as they have a space for 'Mother' then fathers details ?

If your ex has PR then yes he could apply for a passport for your child, either parent with PR can apply
