Lets take the CSA to COURT!!!!

Is it possible? if we get enough people together to find a solicitor to represent us all and take a case to court against the CSA.

The publicity for the solicitor and the pressure it would put on the CSA could only do us good.

What do you think?

My situation is that I was given an award 2 years ago and although my xp is still at the same plpace of employment and hasa a deductions from earning order on him I still can't get any money out of him/them!!

Anyone in a similar situation?

One solicitor representing a number of people who the CSA have failed

Does this make sense? feel I have rambled.

This was on Tonight with Trevor McDonald yesterday. It was a whole programme about the failings of the CSA and there was a woman there who was in the process of setting up a case to sue them.

It was mainly just examples of people who had been let down by the CSA in various ways. eg 30odd reassessments in just a few years. One couple where she received nothing for her kids, but he was paying full wack for his kids, one mother who's ex was paying her £5 per week but living a millionaire lifestyle because it was all family money (worked in family business IIRC), that sort of thing. Then there were interviews with ex CSA employees giving details of dodgy working practices. And interviews with the relevent Govt minister saying how she was going to sort it all out - of course. Dunno if you might find some info on the ITV website.

I'd be interested. Well over two years ago I applied. Got my MP involved. Have so far received the grand total of £21. XP has been at the same address for all that time.

GAS BILL?!?!? Jeez as if you really need heating - just put another jumper on the little brat... oh I'm sorry, what? you mean you want me to the pay for the g*d damn jumper as well?? Did your mother never teach you to knit. I'll give you money for a jumper when you give me more access.

Ahem - you see your dd once a week and I've not had a penny...

csa? (spits) ive had my mp involved. they have all the details of dd's dad and do they do anything about it? nope, they dont. ive been waiting over a year now and not one penny.

Totally agree with all took me two years to get anything from them they fed me a load saying exh hadn't payed a penny to them although he's military and are supposed to get it taken direct from their wages but noooooo I got the social security office someone from sure start and my mp involved and all the time they said he hadn't payed out it was all there and sitting in the csa's bank account but they kept saying it was a fault with the computer system more like gaining interest for themselves, after the two year fight they decided to make a manual payment and OMG they put it in the wrong bank account where the overdraft debt swallowed it up so never got to see the payment after all Grrrrrrrrrrrrrrrrrr they make me so angry

i suppose i was lucky? the CDA told me straight out that they would rather not persue Ex p for maintainance and were very pleased when i said id keep my claim with the Aus CSA. Not that they are much better my solicitor has sent 4 copies of the court order and they are yet to find one! howvever they do seem able to keep me informed and they have a system wher if exp refuses to decalre his earnings he wil be rated at teh max. $100000 so 18 % of that will be lovely every year thank you! still not a cent yet. The Uk CSA did make me laugh because i was totally honest and told them my reason for leaving the case where it was was a/ the reputation of the CSA in the UK and B/ any money DD gets can go into her account in Aus and not be eaten up by rent payments here and C/ I currently have an arsed access order which means DD has to return to Aus twice a year or I have to be seen to be offereing access twice a year. Payments in Aus are rated to contact. So the more time the absent parent spends with DD the less he pays. So as he is yet to see her i will have a better case to stop the access. He will have decalsre no contact!

And just to make you all spit more, my dh who has always paid what he's been asked to, on time and by direct debit has had at least 5 letters in the last 6 months telling him that they've decided he should pay x amount and enclosing paying in slips. This is not as a result of a reassessment, just random letters, and the amount is always the same and what he's always paid.

At one point they wrote telling him that he was paying too far in advance, at the start of the month instead of the end, and their system couldn't cope with it. So he changed his direct debit to the end of the month and they wrote and told him he was in arrears and would he please pay by cheque.

They've also written to him to say he was in arrears to the sum of £0, yes zero, and asking him to make the payments straight, enclosing a paying in slip for £0.

The sooner they're sorted out the better.

Hiya, I would be very interested in take action against them my ex owe over £11,000 in back payment and for the last three years no1 will talk with me about my case I phone every couple of weeks and ask for a call back from my case worker and nothing, yet he has three cars, a house and a work van yet they can’t get a penny out of him. And no1 from csa will even talk to me all I get is we can’t give u any details.

Have they raised a court order yet? I had the enforcement team do this at the end of last year. Ex them moved and was staying with different friends so no fixed abode. Then lock down happened.

I know it's unlikely to see any of the arrears but feel I'm in a stronger position as it's now with the court.

My next reassessment period is Oct. so another years payment and I will push for that to be pursued via court order too.
