How does a variation work with cms? Do you need proof? Has anyone been down this route? Fed up of receiving £6 a week for my children when I know for a fact he is earning on the side and not declaring it. Has anyone done this and been successful?

My Ex was in receipt of a state pension but still working. I asked for a variation order to be made. Unfortunately, the CMS struggle with awareness their own legislation so it took months of back and forth to be put into place.
If the absent parent is working cash in hand, I would imagine it being harder to prove.

It’s money from rental property, I’m not sure if it’s cash, will they be able to find it if it’s going into his account? It’s my last attempt before I give up and close the claim so I want to try because I know he is getting quite a bit of money that way and it means he doesn’t have to work as he earns enough not to.

Do it on the basis his lifestyle doesn't reflect his declared income and you are aware that he has rental properties - provide the addresses if possible.
