My ex hasn't paid a penny in cm for 6 months and has always been on and off about paying over the 12 years we've been separated.

I've just received the annual calculation and it's a joke. I know he works full time (labouring), he rarely visits DS (14) because he's working yet they (the cms) think his annual income is only £3200, £61 a week!

The process of fighting this looks hard especially as I have no proof other than what he tells me and my Son. I don't even know his address (he visits Son here for a couple of hours once every few months at best - he lives in South London I live in Hertfordshire.)

Any help or advice appreciated.

It's so infuriating OP. The CMS told me that it was on me to prove where ex was working as a chef in a city commutable to London when I lived 200 miles away 🙄 How can anyone do that? I believe you have grounds to ask the m for an investigation if his standard of life doesn't match his wages (holidays, cars etc) but don't know anyone who has had success with that

Good luck but you won’t get anywhere. My ex earns on the side but can’t prove it so only get £6 a week for our children

A thought did occur to me earlier today.... could I use the fact that prior to him stopping payments 6 months ago he was regularly (sometimes weekly) paying £50, out of the 60 he supposedly earns, for a while, as evidence...?

I doubt it @bettycat81. The cms are just not fit for purpose and under too much demand because men can apparently just opt out of paying for their kids. Of course some women do too before anyone says it but it's much more common one way round than the other
