Child Maintenance

Hi all

Ds's dad has never paid any child maintenance other than twice when I opened up an account with CMS. They gave him a few chances and when he didn't pay they started taking it from his wages. 2 months later ex left his job blaming me for it as he said he'd rather be on benefits than work if all his money is going to be taken this way

Fast forward he started working a cash in hand job alongside a weekend job and CMS said there's nothing they can do if he's doing a cash job. On the annual review last September they said he needs to pay £29 a week due to his earnings (previously was around £250)

Will they check who he's working for on the next annual review and recalculate the amount? He let slip that he now works a proper job with regular pay so just wondering whether that's something CMS pick up on themselves

Just asking because when I first opened up the case with CMS they were asking me who he works for etc, and it made things a lot easier. This time I have no idea where he works which is why i'm hoping they wont just rely on me to tell them he's moved jobs

Yes they'll run a check again with HMRC and can see what he earns for the previous tax year - it's easier if he's employed; the amount will then go up / down depending on that info

Thank you @NearlyThere30 ! Glad to hear that's the case

Ex cms worker. They regular check with HMRC and if he’s going through a payroll and paying taxes… he won’t be able to avoid it again

@Random458 CMS are absolutely useless. Can you Google your ex? Any known addresses and see what comes up. Next time you have your annual review appeal it and request a mandatory can't remember the correct term but something that furthers your case. If this fails you can go to court!

My ex is newly self employed and I've told CMS his earnings what he has given to CMS are impossible as he still banks me £260 a month. They called him and he told them he was living off savings it's a joke!! I've got bank statements too.
