Child maintenance not paying full amount

Hello,

For a few months now my ex has only being paying between 90-95% of the monthly child maintenance amount. We pay through the CMS so I contacted then but they've said because he's paying at least 90% they can't do anything about it! Is this correct?

It wouldn't surprise me to be honest. I was always told I'd have to report a fair few non payments before they'd act.

Ah ok thanks

It's true
And it's shit :(

radmum81 · 28/04/2023 08:19

Had it happened to you too?
Does what they haven't paid mount up in their arrears or do the child maintenance service not even bother to chase for it??

Same situation here and no they don’t do anything unfortunately.

radmum81 · 28/04/2023 09:53

That's mad! Is it because they deem the father as paying most of it? Will it be added to his arrears? The system is rubbish

My ex hasn’t paid since I reopened the case in August as in not paid a penny, there are arrears but no cms haven’t chased them.

radmum81 · 28/04/2023 11:41

Wow really? Csnt he be forced onto collect and pay?

You need to ask them these questions directly.

I'm owed £30k+ in arrears.

They are useless

BabyJellyShark · 28/04/2023 11:43

A friend just got 9 or 10 years worth of child maintenance back for her now adult children. Her ex partner paid pretty much nothing in that time. The grand total that was returned to her? £29.12. It's ridiculous.

It is collect and pay that’s the worst thing; they told me they can’t force payments though only “request” them, so what’s the point 🤦🏻‍♀️

radmum81 · 28/04/2023 12:38

I thought they could take it straight from earnings without having to request? God what a nightmare. And even worse if lots of absent fathers get wind that they only actually have to pay 90% and won't be chased
