CMS - variation application

I’ve received a variation application from CMS from my ex partner.
Does he still have to pay while it’s being decided or do payments get put on hold while it’s being looked into?
any advice appreciated please

Yes he should pay until they say otherwise

I've always been the one applying for the variation and in my experience payments stay as they are until they have completed the variation process.

I'm in the process of this too. In fact I'm not holding out hope because I should of had a response by end of March.

I've still been getting my payments though.

Please keep on at them. I rang every week till I got somewhere.

It's crap but the more you bother them the more they do.

He has put the variation in as me and the children still live in the house that is jointly owned and he is paying the mortgage, from what I can tell he won’t get the payments changed as he has a financial interest in the property. Is that right?

Tbh you can't expect him to pay all the mortgage and cms.
I guess he could stop mortgage payments or lower them? Then you use cms to put towards mortgage

Tbh I can, I’ve been trying to put the house up for sale since December and he won’t agree to it, if he doesn’t want to sell it and I do why shouldn’t he pay the mortgage, him having to pay both is the only way I’m going to get him to give in and let it go on the market x

Its all online they will likely take into account the mortgage payments.
My ex many years ago had variation for travel to collect dc. Which is fair enough, if i remember right. He said it cost him £50 a month /£600 per year.
They took that £600 off his annual income which lowered his income figure. Then cms was calculated on the new figure. It didnt mean dc got £60 less it was about £8 pm lower overall.

So if it works the same then for example
He earns 50k
Pays 12k mortgage a year
=38k the figure will be worked out on? Minus any over night shared care etc?

Obviously i dont know the figures hes on but that's how the travel worked for my ex
