On Seperation what percentage of Assets did u Receive? Scotland

Hi - I am asking the following as I had an emotionally abusive huband who left the marriage but is still making my life a living nightmare. I put my career on hold through our marriage due to his laziness to find a permanent job and my lawyer is arguing this point. He has even said he is going to give me less that 50%!!!! I would like to know what split people think I could expect in Scotland? I have one child aged 2. My husband is from a very affluent family so he has no money worries and will use his mum and dads money to get his way including paying top lawyers to make sure he keeps his money.

normally 50-50 at least of assets obtained during the marriage-separation phase (doesn't matter who obtained them). As you are with a child (guessing that means you are the primary carer), probability it will be a higher split in your favour.

Of course the court can only go on the financial declarations, so if he is hiding x amount, and you don't know about it, then ....

you should get at least 50% - potentially more if you gave up your career etc.
Sounds like your ex is just saying things that he knows will upset/worry you - just another way for him to be abusive. Stay strong - at the end of the day you might have to compromise some things just to bring everything to a close (in my experience abisive husbands tend to drag things out as long as possible as this gives them an element of control) - but this will be up to you. If it went before a sheriff/judge, I can't imagine you getting less than 50%.
Have you got details of all your joint finances and any finances/assets he has in his name? If you suspect something there are ways to get these disclosed - but only if the case is raised in court.

i think personally that when a couple splits, they should take the money that they have earned and leave it at that. if you paid for the house, you get the house. If he paid for it, he gets it. Likewise if it was 50/50 then split it down the middle.

allgonebellyup that is so ridiculous. I am at home looking after the kids so earn nothing. However my contribution is to the family is just as valid as DHs who brings in a wage.
