So what happens of there is a DEO and the NRP's employer (who is his mateHmm) refuses to deduct the money requested. Ex proudly informed me of this at the last contact he had with dc.

Wee, on the phone for one hour, and they cut me off!
I don't understand the point of their existence!
I don't have hours to spend wasting time on the bloody phone

Sounds awful. Goodness knows. My guess would be that the employer could ultimately be fined for this but that it would take years?

Hi. Did you get any help from CMS about this in the end? I have a DEO set up for my youngest children’s father. I had to switch to Collect & Pay when he started missing direct payments or paying less than he should etc.
As far as I know it is an offence for an employer not to comply with a DEO. They are obligated to deduct the amount instructed by CMS directly from the paying parent’s wages and send the payments to CMS by 19th of each month. However, CMS did inform me that they give employers a little flexibility to make the payments by the end of the month.
If an employer has been sent a DEO from CMS then they have to cooperate otherwise they can be fined £1000 and/or taken to court - which I’m sure your ex’s employer wouldn’t want lol
Do you know if your ex is officially employed there and pays tax etc? I’m assuming he is because CMS would have checked and I doubt they can send a DEO if the person wasn’t employed and being paid officially?
I hope you got the help you need from CMS because I know fully well how hard it is to get through on the phone let alone speak to someone who has answers or even knows what they’re talking about lol
I always ask to be put through to a case manager or whatever they’re called because often the first person who answers the call doesn’t have full access to all the information and case details.
It might be worth asking them if they can take the money directly from your ex’s bank account. They can freeze his account so that money can still come in but he’s not able to access it until payments are up to date.
I’ve had so many issues and encounters with CMS about so many different things I have lost faith in the system but it won’t stop me from fighting for what the CMS calculate my ex must pay for my children.
