Will CMS end my case?

My ex stopped paying CMS after a breakdown in contact.

So I applied for them to take it directly from his benefits. This was in place for six months when they said he could come off and be given another chance.

CMS have contacted me a number of times asking for me to give my bank details to my ex and I haven't given it to them.

Reasons -

£7 a week, is a piss poor contribution.

He doesn't see her so why should I let him feel better for contributing to our child's life.

I don't need anything from him. Dp and I provide everything she needs.

My question is - will the CMS close the case if I don't give the bank details? Or will it keep racking up and then I can ask for them to contact him in the future should my opinion change?

I really don't fancy being stuck on the phone to them, and never get a straight answer via their messaging system.

If you refuse to give bank details then they'll probably end things because you have an option to get his pittance and you aren't cooperating. Better that £7 in your pocket than in his. It's the principle not the amount.

Great idea.

Set up a separate savings account. It will all add up eventually!
Better £7 per week then him not contributing at all.

Doubt it, my ex pays the same but only for our FOUR children, I’ve been trying to cancel it myself as I don’t want to claim it anymore and it’s been a nightmare trying to cancel it!! I’ve called so many times to close the case but they won’t do it. Why do you have to give him your bank details mine was taken straight off him?

It can't go into my daughter's bank account it has to go into mine or it doesn't count. I asked CMS this one before.

You can give a PayPal address if you don't want to give bank details.

If you opened the case you can also close it and they will not carry out any further assessments.

Well if he remains on benefits you won't get any sort of lump sum anyway. It'll mount up in theory but he will always be capped at paying £7 pw. I imagine they'll just write it all off once dd is 18

Yes they wrote off over £1000 of my exes debt because he was never going to pay it he had been on benefits for years, none of my kids are 18 either they just wrote to me to say they would be writing off his debts

Open a Monzo account from your phone, today. All you need is your ID and their app. Give him the bank details. He'll undoubtedly start to miss payments within a few months. Close the account and move on with your life. If you catch wind that he's earning in the future, you can open a new claim.

Well yes they wrote of my ex's too and my youngest is only 8. Was just thinking of a best case scenario 😆
