if my ds dad has nothing to do with him, do i automatically get full custody, or do i have to apply for it?

When we first split up my solicitor said we had joint custody still. But its been nearly 2 years since ds's dad last had any contact with him

Do i now automatically have full custody or do i have to apply for it through the courts?
