“Shared” care and CMS

Just looking for some advice or anyone that been in a similar position with the other parent having 50/50 solely in order to not pay maintenance.

Do I have a leg to stand on in terms of going to CMS as I am providing the majority of pastoral care?

Basically ex is just very selfish and if he can get away with not doing something he will. Doesn’t organise or take them to any appointments, won’t pay half for clubs, argues about cost of paying half for necessities (genuinely don’t for anything extortionate) asked him to pay half for daughters lunchbox as it’s disgusting and 2 years old, refused, it was £4.

How shared is the care, ie is it exactly 50/50, 4 nights one week , 3 nights the next at dads? If it’s bang on that then you probably won’t get any…. If it’s not truely 50/50 then worth a shot. It’s based on nights at the other house per year. So whatever the weekly amount is x52. The amount then deceases as the nights go up. Try the govt CMS calculator

It is exactly 50/50 as it goes on nights and apparently CMS don’t give a toss about the daytime!
Basically they’re collected after tea to sleep then returned the next morning so they’ve done their “night”

Take it to court to explicitly put pick up times and drop off. No decent judge would agree to 50 50 in this manner.
