I have a question / issue with child maintenance and wondered if anyone can help. I feel like I’ve been wrongly advised by solicitor on this issue and now I’m stuck 😞. My ex husband left 2 years ago and has not paid any maintenance since then. He has kids few weekends an month And extra school hols. He refused to pay and said he’d just take kids more or off me ( which no one actually wants just an excuse). When we did the consent order my solicitor said that maintenance wasn’t included and I should apply toCSA (or whatever they are called now). Turns out I can’t do this for a year after consent order. So that’s 3 years of nothing from him. I’ve written a complaint to solicitor but is there anything I can do ? He doesn’t pay for anything for them (dinner money even on days they are with him) or clothes etc etc. I don’t know why solicitor didn’t say I had to wait a year. They also told me divorce hadn’t gone thru when it had.

You only have to wait a year if your financial consent order includes a figure for child maintenance. If it does not you can go straight to them.

Yes as above poster says, the 12 months is the length of time the order needs to be in place for. If there is no order in regards to payment then CSA can begin immediately.

As above op, if your consent order didn't include a figure for CM you can call CMS first thing in the morning!
