Exh wants to take ds 3 to poland

hi all
Exh announced last night hes taking ds 3years to poland in january. Given the pandemic im not happy about this. Anyone know if i can block it? To my knowledge ds doesnot have a passport.

You can apply for a prohibited steps order to prevent him going, as legally either parent needs to have the others' permission to remove a child from the country.

In non-covid times I would say that without any other reason as to why you don't want him to go, YABU and would likely be told as much by a judge (my ex refused permission for me to take the dc on a family holiday to Spain and was virtually laughed out of court, I was also awarded a residence order which allows me to take them for up to 28 days).

However, the covid situation muddies the water somewhat - if it remains on the safe list I suspect he would be given permission to go (if he took it/you to court), just as many folk travelled abroad this summer. Do you have any other reasons why your dc shouldn't go?

Poland in January will be very very cold.

Oh, and either parent can apply for a passport for the dc. Prohibited steps order for you if you want to block the ex taking him, specific issues order for your ex if you refuse to allow a reasonable request for a holiday.

I would apply for a passport pretty sharpish . You may find out he's already made an application ? Def get a prohibitive steps order. Poland will be freezing at that time of yr. Is he intending to visit family there? That might change the court's view

I think Poland has managed the pandemic v well and has had a low number of cases and deaths all along?

Having said that, if you don’t feel your son should be going abroad, then you can take the steps above.

get a passport sharpish for your child and hide it.

if he already has one for him -get yourself to court asap

Does your child have dual nationality, could dad get a Polish passport for him ?

No hes not dual nationality, exh's new girlfriend is polish, exh & i are both british
