Hi

Does child maintenance affect tax credits?

Does anybody get more from there ex partners than the calculation states based on earnings?

Thanks x

No child maintenance doesn't affect any kind of benefits you receive now. That's what citizens advice told me. My exP is asking for a mandatory reconsideration of the amount he has to pay as he claims the amount they've calculated will leave him financially destitute!! Load of BS

Another no. It has no impact.

Your ex can pay however much they want in a private agreement. It's worth checking your entitlement on the government maintenance calculator to be sure they aren't spinning you a line.

It doesn't affect benefits. It used to but because it's so often not paid, it left the receiving parent in terrible difficulty so the two are entirely separate. Many decent dads do pay in addition to the cms calculation but a lot don't and you can't legally make them, even if the calculated amount is v small. DO NOT listen to anything your ex tells you about it. Open a case with cms and let them sort it out. It's not a punitive thing, or doesn't have to be it just formalised it and removed one area of contention.

I think the only thing it can impact is spousal maintenance from memory.

No it doesn’t. Although I did read on UC credit calculation that CM can affect Council tax benefit depending on your area. Never looked into though.
