Furlough and CMS

after months of going through cms this is the first month it should have been paid.

Ex has taken 20% off as he is saying he had been furloughed. Can he do this? Appreciate times are tough for a lot of people right now but my understanding was it didnt change until the salary difference was 25% he lives at home so has no bills, mortgage etc to pay

No, he can't do this. If he pays below what the CMS has stated it will build up as arrears. Let them know he has underpaid. If he wants to appeal then he will have to do that, not just underpay.

The pp is correct. Minimum of 25% change before it triggers a, reassessment other than at the 12 month review.

Furloughed doesn't necessarily mean 20% less pay. My oh has lost 45% because it only goes off basic pay, not discressionary payments, and those make up almost half his usual wage. CMS has refused to amend the claim even though if we do the calculator on his new pay it's roughly 100 pound less. What's all the more annoying is that said child is actually an adult and was practically given a job on a plate and walked out on it. And we can't even speak to a sensible human about it because 1. You have to do it online 2. They always take the resident parents side

Furlough is 80% up to 30k salary after that its £2500 which if your take home pay is usually 5k is a big drop so its possible he has lost more than 20%

After years of refusing to pay or finding excuses I had a deduction of earnings set up. The employer doesn’t always send through until months later which is another annoying issue. I haven’t received anything since February. My ex says deductions were taken from his Feb and mar wages but he can’t chase employer as they got lots to deal with right now!! He said business had closed (quite realistic as it was a kitchen sales business) He was earning £30,000 so I asked have you been furloughed and he ignored me.

Few weeks ago I messaged CMS online and received response saying response would take 12weeks. Today I called and was told they will not chase any missing payments at all for minimum of 12weeks. I was told just claim universal credit instead! I said won’t be eligible as they will look at mine and my partners income and we won’t be eligible and I doubt they’ll just pay me the missing maintenance. He replied and said well you are in receipt of an income that means you can cover the basics for the children. I said I actually would like the maintenance so can purchase another laptop as they have to share one to do their school work plus I shouldn’t really have to justify what I need to spend it on. My ex actually left me with debt that was his fault which I did repay but for all he knew I need the maintenance to cover debt repayments etc.

From my experience today they really are not bothered with missing payments for children/receiving parents. I am not a fan of the CMS at best of times but today I was really annoyed with the man I spoke to.

@alphabetti I wonder if it was the same man my oh spoke too. Really snotty. I mean we're actually at a point where there could be fraud going on at the recieving parents side as the 'child' hasn't attended college at all but because she is enrolled on a full time course regardless of attendance we still have to pay, and the mother is still getting all the benefits too. But when we questioned the potential fraud it wasnt his problem as the 'child' is enrolled. It's so unfair the whole system. We're also on the other side of the fence, and if my dd dad couldn't afford the full payment I would be understanding. We're all up shit creek at the moment. We just have to cut back on the non essentials.
