CMS Arrears

Can anyone please tell me, if the CMS where to take arrears on collect and pay when would I expect to receive them?

He’s having quite a substantial amount of money taken from his account each month, the first payment being on the 1st July. It hasn’t come to me (he has another child but he’s 22 now) so I don’t think it’s my arrears.

I’m getting so much abuse from him this week (second payment must have been taken).

My claim is quite new, so I’ll m struggling to understand what’s going on and the CMS won’t tell me much, another reason I don’t think the arrears are mine, data protection and all.

In my experience The amount paid to you should be your basic Monthly amount plus arrears. They try to divide the arrears over the months left before the next assessment period.

They can take up to 60% of his salary if he isn't happy with the amount being paid then he needs to talk to the cms. They can change the period the arrears are paid back by.

Maybe he should of just paid up at the start. Just direct him to Cms. This is not something you have any control over.

Yes, they did add some arrears to mine and worked it out over the monthly payments which is another reason I don’t believe it to be mine.
This is two separate payments on his portal, one collect and pay and ours direct pay.

I’ve told him to ring CMS he said he has and it’s mine, probably lies so he can just use me as the punch bag.

I would be putting it to one side and see how it goes. Or ask your mp to investigate if you are concerned about any repercussions

Yeah it’s strange.
It’s more than £4K of arrears he’s paying.
I’m pretty sure his ex didn’t take him to the CSA (would have been back then)
