Hi everyone,

I'd appreciate any advice on the following
I've recently separated from husband and he's moved back to Portugal.

I'm now looking to divorce and apply for full custody but will the courts allow full custody since he doesn't live here anymore?

Also, it states on the government website that a mediation is required first, but he has refused to return to the UK, demanding that I send the kids, a 6 yr and 3 month old, to Portugal during the holidays, which I would never do.

Can I apply for full custody?

I think the courts would still want some contact facilitated but it would be up to your ex to make that work since he moved away.
At those ages he needs to come to you to visit, surely.

He's insane. The three month old will barely know their father, I doubt they would be happy to go and stay with them? It would be a massively upsetting for both children, he needs to come to the uk.

If I were you I would do nothing for now.

I would book even a 30 minute free appointment with a solicitor . Do your children have duel nationality?

I would also agree at that age he needs to come w you.
