Thinking of starting a petition regarding the failures of the CMS

How would you like to see it improved?

For example I think failure to pay CM should be illegal and lead to a prison sentence.

Would like to hear your thoughts.

Same should be for mothers that lie and damage the dc and stop or hugely prevent contact.

I agree.

However maintenance and visitation are two separate issues. The lack of one shouldn’t negate the other.

Most of the failures of CMA are down to self employment, where one party use "tax avoidance" systems to pay themselves, then use the same rules to avoid maintenance.
How many of those who don't receive maintenance from their self employed ex complained that their partner weren't paying enough tax when they were together.

The CMS should be held accountable for their processes (or lack of) - 4 months they had a copy of my court order & only actioned it when I called to query why it was taking so long & I got "we can't back date it to the date we received it only from the date it was processed"

for this to work the CMS would need to be willing to enforce it & as they can't enforce the powers they have currently I wouldn't hold my breath!

The staff need to be better trained - I've lost count of the times I've had to tell them how the system actually should works including doing the calculations in my head faster than the guy on the phone with his fancy purpose built system Hmm

How long do you want the petition to be? Lol.

Failure to stick to deadlines
Making PWC find out the information re jobs and address
Failing to do a simple google search to discover that the NRP isn't in fact unemployed and claiming no benefits but the owner of a business
Using common sense when it comes to excuses from NRP
Only doing work on the case when hounded by the PWC
Sticking to their rules eg going to collect and pay when there has been DV and consistent proven non-payment, using enforcement action available (freezing assets, blocking passports, removing driving licenses which the new CMS are meant to be able to do)

And that's without thinking lol.

I think the main problems are

  1. Slow progress - unacceptable that it takes months/ years for money

  2. Non-payment should go on the credit file of a non-payer.

  3. If someone doesn't pay, CMS should pay the RP then pursue the NRP as if they hadn't paid Council Tax/VAT

  4. The self-employment loopholes- if NRP claims to earn £100pw then that figure should be the income used when NRP gets a mortgage, loan etc Why is the onus on RP to somehow know what their ex earns?

  5. Many cases only get expedited when people complain to MPs. This is unacceptable.

  6. I've read on here about RP being owed 5 figure sums in maintenance. Totally unacceptable. The CMS need to stop their policy of asking RP to write off debts.

  7. Some NRP quit a job every time CMS catch up with them. RP should automatically get the minimum amount £7pw from CMS then CMS should pursue NRP. Obviously some people get made redundant for innocent reasons but the serial quitters should be fined.

They already can be sent to prison for non-payment. The issue is that CMS rarely take any actions outside of writing to them.
