Relevant other child - CMS

Finding a definition for a relevant other child is hard.

Exs partner has her own house which she lives in with her children. They also stay at my exes.

Ex has said that he's supporting another child in the household. Ie, girlfriends son. To reduce maintenance

Cms say that as long as she is claiming child benefit at the address then I would have to dispute that they live there.

How would I do that?

Electoral roll?

He's said that because they're there at least 3 nights minimum they're classes as living there.

I can’t see there’s anything you can do about it then.

Are they classed as living there though if they're there 3 times a week minimum. She has a separate house?

The CMS has already told you that they consider that to be living there, so yes. The child benefit office has accepted that as her address.
I would imagine that tax credits/universal credit would also say they were living together.

Whataknobhead · 08/11/2018 11:04

They haven't though. They have said they check child benefit but also said there's nothing to stop her changing the address to his whilst still remaining at her place.

I guess I'm just curious as to the definition of living together in these cases.

Who is “he” in this sentence?

I bet they don’t have a joint claim .

If she has her own address and she is claiming wtc as a single parent it is fraud

Cherries101 · 08/11/2018 19:40

Is the number to report a benefit cheat still available? You could report him and her.

ohnothanks · 08/11/2018 19:42

He might find himself having to support her and her kids if she is making a single claim for WTC ;) Which would be shit for you but some sort of justice!

Santaispolishinghissleigh · 08/11/2018 19:43

Report her to tax credits.
