So in the process of obtaining a CAO for the children to reside with mysekfvtgeir mother.

Am I right in thinking that with this in place I can take the children out of the country for up to 28 without written permission from their father who has parental responsibility?

Many thanks

No you can’t, it can only happen with permission from the other parent with PR

Thank you. That’s just what I thought.

If the CAO states the child resides with you, then you can take the child abroad for 28 days without permission.

Thank you, yes that’s what I thought however my ex wants the CAO to state that I can’t! Not sure why he’d want that?

If you have a CAO in place and wanted to move home within England can you?

The Court is unlikely to agree to that. They may specify that you have to provide travel and accommodation details if you abroad.

Again if the CAO is in your favour, there are usually no restrictions regarding moving. The other parent can however apply to the court for the CAO to be amended or a Prohibited Steps Order preventing you from doing so.

Thank you for confirming that for me!
