My ex stopped payment of CMS on 1st June so I contact CMS to get the ball rolling.
There was a delay because my ex ignored their attempts to contact him.
They issued a schedule based on our arrangements early July, however they have not factored in that he pays another ex for another child.
I've spoken to them last week and they said that they are checking their systems for the other child. But as its a private arrangement and not through CMS I'm not sure how they are checking this. They've told me that he's to pay in line with the schedule until a new one is issued, however, when I asked what would happen if he paid a reduced amount on the basis that the payment towards the other child hasn't been factored in, they said that they'd deal with it if and when it happens. They said that a revised schedule would take into account the payments that have been made as per the current schedule.
My ex is currently due to pay me 200 pounds more than he was paying prior based on the schedule in place now and will be due to pay me 100 pounds more when the recalculation is completed.
He has told me that he will be paying in line with our family based arrangement until it has been resolved.
I have told him that he is supposed to pay in line with current schedule and any new schedule will factor in payments made. What action will cms take if this happens if he pays a reduced amount?
