Useless CMS

Having to really restrain myself right now.

CMS just called. They can’t continue criminal proceedings because he’s on the dole. So apparently, he can break the law all he wants, as long as he stays on the dole because they won’t punish him then.

But it’s the same cycle for the last 26 months. Dole for 8-12 weeks; with no deductions from benefits because DWP always fail to deduct anything. Job for 8-12 weeks, deduction from earnings fails as HMRC don’t pass details on fast enough. Bailiffs fail because he’s of no fixed abode. And now no criminal proceedings. Because the poor lamb is on the dole.

Except he lives with his fucking sister and her, their other sister and his mother fund all of his luxuries. He’s had FOUR holidays abroad, several in the UK. Designer clothes.

CMS said as soon as he comes off the dole they’ll continue the criminal proceedings. But that’s no good; the aforementioned systems never update in time and the CMS have no way to check if he’s still currently on benefits.

What is the fucking POINT. There’s so many massive loopholes for this waste of skin to exploit.

He also has zero contact with DC - his choice entirely, he failed to turn up to mediation numerous times when I was still desperate for him to be involved with DC. DC was a planned, wanted pregnancy created within what I thought I was a great marriage. My MH has only just started to recover from him abandoning us when I was pregnant (I got home from college to find all his stuff gone, phone off, his family wouldnt respond to me) and the subsequent severe PND caused by the sheer exhaustion of raising a newborn (who had numerous health issues and didn’t sleep for more than an hour at a time until they were 19 months old - I also have 2 older DC with exH1 and we have 60/40 split, he attends all school related things and is very hands on, so going from extreme to the other in terms of type of rather shocked me to the core.)

Can I ask what the criminal proceedings are for? Not paying maintenance? My ex didn't pay for 7 years nothing ever happened about it. I've only finally started receiving 7 pounds a week now for 4 children. (He's on benefits aswell)

sorry to hear the situation you are in. Sounds awful.

I'm having a right time with them and had to get my MP involved. I do remember though clearly (as i was taken aback by his honesty) that one guy there said that we only threaten proceedings. We almost never actually take anything further, its only a threat! Was horrifed. So basically they actually dont have any powers like they lead you to believe and the arseholes can get away with their games

Turns out that’s a load of bollocks. Why send him threatening letters and telling me it’ll definitely happen if it’s doesnt? I bet he’s laughing his arse off at me on the F4J page.
