CMS- ex overpaying pension

I am really confused by this. Just had a letter from CMS saying ex's child maintenance payment will be going down (a lot) as he is paying over £10000 a year into a private pension. I phoned CMS helpline on Saturday and they say it is correct and there's nothing they can do.

I've found information online though saying you can apply for a variation based on diversion of income which had a very similar case to this.

Has anyone had similar and if so what did you do?

It just seems so unfair on our daughter- she's already unhappy he doesn't see her much and won't play with her because he says he's busy with younger children (from new relationship). I am then going to have to cut back on her out of school activities and maybe school dinners because of this. Of course I know he is entitled to a pension but I'd love to overpay my pension but can't because I need to pay for childcare etc and more than 1/3 has gross pay is going into his.

I’m afraid nothing you can do

Payments are based on post pension income.
