Child Maintenance Sanctions

Hi,

Has anyone ever experienced an ex partner being subject to further sanctions from the CMS or CSA, as in commital to prison or disqualification from driving?

The only bit I know about is you can't claim any maintenance while they are in prison but if you tell them when he's released your claim will start from that date. Hth

Csa called my mums ex’s place of work to take his money straight from his salary. He owned a huge bus company and csa told him he had one week to pay or they’re revoking his liscence, he paid up. Now he doesn’t even see the money it just shows as a deduction of wages

I dont believe they do either, They are all talk and no action.

Nope never heard of this ever and I know plenty of people whose exes don't pay Cms.

My ex partner has never paid. There have been deduction of earnings orders but he leaves the job before any money can be taken. The CMs have 2 Liability Orders now, for over £7000. They've tried bailiff action but haven't got anywhere as he doesn't respond to them. They've now said they're investigating whether he has the ability to pay and if so, they'll be looking to pursue additional sanctions if either prison or disqualification from driving. I just wondered whether anybody had any experience of this process.

I think its just something they say, I find them exhausting they have to be pushed and pushed to do their job, Completely incompetent service and will never change.
I gave up fighting as it was too stressful and I found I was paying out more money in phonecalls than I was receiving in maintenance as he did the same as yours, Changing his bank account also when he thought they would try and take it directly from his account, he currently gets his wife to work so he doesnt have to pay as they dont count her income. Its disgusting and a real problem in this country. They should be imprisoned.

The whole thing is an utter disgrace and too many loopholes that need to be closed. My ex-h and OW run a business together now. It appears that OW pays ex-h minimum wage and therefore maintenance for our DS is minimal. However, they can afford a most opulent "lifestyle" and appear to want for absolutely nothing. What disgusts me the most is the lengths these vile fucks will go to to avoid paying for their offspring and the women who enable it. I don't know how they sleep at night. Our son has ASD, therefore I have the option of an application under the Children's Act. This is not a route available to everybody unfortunately. There is so much that could be done (and is currently slowly changing) with this outdated system. It is time we adopted the more stringent approach of countries like the US for example. Something really has got to give. It's a disgrace.

Totally agree, I really cant see the attraction in someone who doesnt pay for their kids or see them as in my case.
Totally off putting. I think the women are just desperate with low self esteem tbh.

No experience of further sanctions here, but I would encourage you to keep chasing the CMS with weekly phone calls at least to see what action they have taken. And write everything down - i.e. If they say they will send him a letter you phone back in a few days and make sure that letter was sent. The whole system is so frustrating.

I'm writing down my questions before I phone them now.

The CMS recently told me that my case was being prioritised as I’d rang in a certain number of times! Crazy!!!

I think I rang in at least once a week for 7 months and finally got what I should have received 7 months previous!

Such a disgraceful service Ipaid £20 for 2 years ago!!
