Overnights and CMS

I am in the process of separating from H and we are currently trying to sort out the arrangements with regards to the children.

He has proposed 50/50 – however, what constitutes 50/50, is it literally 3 nights at one house and 4 nights at the other? Does this actually work in practice?

I understand that if you have a 50/50 agreement, no CMS is paid, is that correct?

I was thinking they could spend 1 or 2 nights during the week at his and then every other weekend. Presumably if this were the case I would get CMS? Is that the case even if they spend 2 nights a week at his, or is it just 1 night during the week they’d have to spend with him for me to qualify for CMS?

Is this about money? the maintenance you will be entitled to depending upon how often the baby's Dad spends with him overnight? will you will reduce the amount of time with their Dad to make sure you get money?

No, I'm happy for him to see them whenever he likes. However, obviously it costs money to live and I'm in the process of trying to work out my finances and whether I can actually afford to live where I currently do, or whether I'd have to move area to somewhere cheaper.

How about they have 1/2 nights at yours and every other weekend at yours - place the financial responsibility on your exH - that way you can minimise any costs you may incur.

50/50 works when both parents make it work

3xcookedchips - Because realistically for our situation that wouldn't work. I work part time and he works full time, so I'm around a lot more for school drop-offs and pick ups etc.

Just use the CMS calculator. Put in the info for 3/4 nights a week and see what it brings up.

Yes 50/50 is based on number of nights.
