Hey. So exp doesn't pay for dd. he left us before having a chance to sign the bc. What I want to know is if I make a claim through CSA if this will give him visitation rights. I would far rather he didn't at the advise of friends family and the health visitor and we are all agreed he will just dip in and out when he chooses.....

CSA and contact are treated very separately as they should be imo.

In my case ex wasn't on the BC. He paid for almost 3 years before we established contact.

Did you choose to establish it?

I left the door open but ultimately it was his choice to start contact. It was something I wanted though.

I think it depends though. If you feel t would be more damaging to have him involved then you might not want to push for it.

How old is your DC?

She's 14m

Makes no significant difference really if he's on the BC or not. If he's serious about contact and is willing to go as far as Court then he can easily get PR via the Court system, they very very rarely deny applications for PR except in serious circumstances such as child sex offences etc.

He has no rights to see your child whether he's on the birth certificate or not. Your child has the right to a relationship with her father.

As others have said, his financial responsibilities are legally seperate from your child's rights to a relationship with him.

Even if he never paid a penny, he could quite easily establish parental rights (through court) and pursue contact, I'm afraid.

The CSA doesn't exist for new claims now - you need to talk to CMOptions about how to move forward with claiming for your daughter.
