What is the problem you're having?

Mummystevo · 13/03/2012 20:10

Iv gone from the old system to the new system with my daughters dad they've told me that I'm entitled to £29 a week maintenance but there gradually introduction the rise so this year il get £5 a week next year £10 a week and so on can they do this?

Yes they can. The normal outcome of a phase to CS1 to CS2 is a decrease in child support, so the phasing is there to help the Resident Parent prepare for the change. But that means it has to happen the same way the other way around too.

If the amount is going to change, then someone is going to be on the bad end of the situation. Sadly on this occasion, you are the one not benefiting from the phasing.

It's shocking they've said il get the right amount in 2017 my daughters 17 now so I won't get anything then, is it worth appealing against?

I don't think there is anything they will do about it. No NRP can make them change the phasing when it is them who is penalised by it, ie. they are paying more than they should be on CS2 for many many years. So the same happens the other way around.

ChocHobNob · 14/03/2012 21:38

Although I do believe if you close the CSA case, wait a minimum of 13 weeks and reopen a brand new case, it will be on CS2 at the assessed amount. You should check with them that that is still correct though.

An NRP doesn't have that choice though.
