If my marriage breaks down and we decide to separate what does my husband have to pay towards? I work 16 hours a week, we have 3 children, aged 5, 2 and 5 months. We have only been married for 3 years though. Our home is in my husbands and his fathers name, therefore will I be forced to move out? Am not leaving without my children.

If the kids live with you, then he has to pay child support. You can decide between you how much this is, or you can go through the CSA who will work out what they think he should pay. Have a look on the CSA website - there is a calculator that will work it out. With 3 kids, assuming they live with you it should be around 25% of his net income (after tax). Your own earnings are not taken into account.

The house (and other assets) is separate, and depends on your divorce settlement. If you're married then the default is that things owned by you and your husband are split 50-50, but this can be contested, and I'm not sure what bearing your FIL's ownership would have, so you'd best speak to a solicitor on that one. In reality whoever most wants to split up is likely to be the one that moves out, with or without the kids.

You can also get tax credits if you keep up your 16 hour a week job - again see their website for how much you'd get.
