Any experience of CSA deduction from earnings?

Hi there.

Brief history is that after 4 years of sporadic contact my ex decided that he did not want to continue seeing his children. We had an informal agreement whereby he paid me £200 every 3 or 4 weeks but this has tailed off in recent months and now stopped altogether. I have contacted the CSA twice before but never asked them to collect the money - the ex would always turn up again making his promises to spend time with the children so I gave up pursuing him as it was never about the money. I have now realised I cannot force him to see them.

Anyway, due to all of this I contacted the CSA several weeks ago with his work details. They have been fantastic so far and very efficient regarding assessment and informing his employers of the deductions. What I would like to know of anyone with any experience of this process is how smoothly things will go now that his employer has the details? I do not have a home address for him - will he be aware of the deductions to be made?

He has no other children, just a girlfriend who he supports so that she can make his tea, do his washing, ironing and put up with his moods :)

He will go nuts when he finds out and will probably quit his job and go self employed anyway!

I have a deduction of earnings order in place via the CSA. Like you, when we first split he arranged to pay monthly when suddenly he stopped without even telling me. I haven't had to do anything. The employer has to send the money to the CSA who then allocate it to me. My ex works for the NHS so it was reasonably easy for them to sort it although they are often late sending the payment and I have to chase it up. But it's your only hope of getting money from someone who doesn't want to pay imo...

The process of DoE is relatively simple and something the CSA "like" doing.

The only difficulty is the exact one you mention that if he goes ballistic at what you've done he could go self employed, move abroad or something else.

Just hope that he pays up...

i have been trying to get them to put a DoE since last march!!!
and now that he ahs offerd to pay by dd, they are gicing him yet another f'ing chance. i don't want that cos he has in thepast found it only too easy to stop dd payment to csa and will do so in he future so i hope you have better luck

Thanks for the replies - fingers crossed for pay day then! It will be nice while its lasts.

He doesn't want to pay, I work full time so he doesn't see why he should pay - seriously, he is bemused by this. If I had a fiver for everytime he said he would sort out the arrears I wouldn't even need his bloody money. He doesn't seem to get that its for them or understand how expensive it is as he is too busy on his frequent holidays or deciding the colour of his next mercedes. I already have two liability orders totally £22k and his current calculated arrears stand at £6k - I was quite happy with £200 a month and regular contact but now he has been orderd to pay just short of £1400 a month which includes an amount to pay off his arrears, for an intelligent bloke he can be really stupid....

he is one of those like your x but thinks that cos dp is ft, then x shouldn't have to pay. dp also has a son from his first marriage

it's easy for other people to say to think positively and to be strong but the thing i have learnt is that i have found i don't haev to rely on his 'payments' of csa, he doesn't haev any power over me (which he doesn't like either but tough cheddar to him). you odn't have to rely on his payments (i think from what i remember of your op) and if you have given his work details they should be able to find him through there

Bear, it took about 5 months so quite a long time! Because they have to go through the motions of sending him various letters etc and giving him the chance to reply or comply, which of course didn't happen. You just have to hang in there - good luck!

I think I have been quite lucky as they have him registered as 'non compliant' already so they got the forms sent out pretty quick. Lucikly (?) we work for the same company so I was able to forewarn the pay department that the paperwork was coming but not sure what influence he will have from the company end. He has been a real shit work wise now that he has decided he doesn't want to see the DCs so I have tendered my resignation as I got no support from management as he is a director and big fee earner so things have become very awkward . All very complicated but a case of onwards and upwards! Pay day is Friday so we'll see how much abuse I get once he realises! Water off a ducks back now :)

Can I ask if the CSA keep a percentage of the earnings if you use this method? Am trying to balance up the advantages of going down this route as opposed to carrying on through the courts....

Hi Sapphire, not as far as I am aware, I believe the amount they assess is all yours. I think they allow the employer to deduct a nominal amount of one pound as an admin charge. It's the best thing I have done as I do not have to have any contact with my ex which suits me down to the ground. :o

Aurora - how are things with you? I am not in a union and my ex is a company director. I have taken legal advice and may have a claim for constructive dismissal, but to be honest I am not sure it's worth the hassle.

not too bad today thansk x still being arrogant arse. when he changed access to suit him with 2 days notice then turned round and said it was his weekend the foolowing weekend, ileft a message on his landline that 'oh great i can leave a messsage so that you cnnot pretend you can't hear me. cna you can please rearraange your shfts as it is also your weekend 2-3july' this was left 9th june. he's turned round and said it was too short notice!!
now he's spoken to dd and said he would see her next weekend. ffs he changes the rules to suit himself all the time!!!

bear what has your legal adviser said? it may seem like a hassle but if you have a strong case it hink it may be worth the look on his face when you win

CSA are stupid, im a paying parent, my ex partner stopped me seeing my daughter over 3 years ago for nothing and ive been offering her money constantly and trying to get contact which she refused,' appartly her new bf is the dad'and 'she doesnt need anything off you' but rings CSA. she rang csa and got it backdatedand has requested a DOE, now they take £73 out of my wage everyweek when i only get £215 a week after tax :/ and girls wonder why men go self employed. i love my daughter and will happyly pay but leaving me with £142 a week with another daughter, car, rent, work fee's blimey self employed is the only way.
FROM A FARTHERS POINT OF VIEW! Definetly dont go for DOE as he probs isnt a footballer and wont be able to afford to work anymore.
