DS in school in spain - resident in UK - advice please

My DS (5) is in school in spain where we live, but we are officially resident in the UK. We have to remain resident in the UK (it's complicated, but we own a UK company and pay all our tax in the UK). Now he is of official school age in the UK I am wondering how long it will be before we get a phone call or letter about why he isn't in school. We have a UK address and doctor etc.

Does anyone know what the situation is here? I am happy to claim that I am home-schooling him, but would prefer to be honest if I am asked and say that he is in school in Spain.

Any ideas? Advice? Or anyone know where I could go to find out the answer?

Hi there

Why can´t you be honest?? Surely if you are paying tax in the UK you are within your rights to live where you want or am I just being a bit naive...

Never queried ds, we itnitilaly went for a year when he was 3 but stayed away4 ! We rented out our UK house, after a while the gp registration did lapse despite us saying we would return. You could just tell the LEA , the systems don't link anyway.

Can't you be UK domiciled but non resident for your company ? We paid UK taxes on income here(and got tax credits and Child benefit!) and Swiss taxes for income there.

They won't care. We got sent school forms when dd was approaching school age so I phoned and said she was in private prep and they said righto, didn't even want to know which one and I have never heard from them again.

If you're not taking up a place they are not interested.

Ok excellent! That is all very reassuring.

I could be non-resident in the UK, but want to retain my residency status. there are very few benefits of being officially resident here in Spain for us.
