we have a bit of a issue with a tree that is `owned' by the local parish council and i was wondering if legally we had any rights (or something like that!)
Its an Ash tree about 50 foot high and its on a slim slip of common land between the stream that runs along our garden and the village hall (so in reality its about 20 - 30 feet away from our house)
Technically the parish council takes responsibility for it but virtually nothing has ever been done to it since my neighbours moved in 30 years ago. The problem is that this tree seems to have had a growth spurt this year and now leaves our garden in virtually total shade from 2pm onwards. As a result the kitchen never gets any direct sunshine (but it would if the tree wasnt there IYSWIM)and its like it is in a morning when the sun is on the front of the house.
We've been in our house about 2 years now and i have phoned the parish council sparodically about this but had no repsonse so i'm thinking of booking an appointment to see a councillor in person. The neighbours say they have complained in the past about the tree but got nowhere (but it doesnt affect their garden as much as ours)Incidently we had a tree surgeon round earlier in the year who said that the tree could do with `a good loping'
I was just wondering if a) anyone has any good advice or b)i've got a leg to stand on!!!
