They ruled in favour of the company we complained against. Initially the adjudicator ruled in their favour,a nd we asked for it be referred to an ombudsman and he also ruled in their favour. We are very unhappy at the outcome. They (ombudsman)have sent us a card in with their ruling, the card says that we can accept or reject the final decision, nd goes on to say that if we accept it will become legally binding and if we reject it will not affect any legal rights we may have.

TBH I am not entirely sure what that means, we of course don't accept the decision, but what can we do now?

If you accept the ombudsman's decision it is binding on both yourself and the company. That would be important if the ombudsman found in your favour - the company would have to compensate you appropriately.

As you haven't accepted the decision you still have the right to take the case to court. This will, of course, be more expensive. Without knowing more details of the case it is difficult to say what chance you have of winning in court but the fact your case has been rejected by the Financial Ombudsman suggests your chances are not good.

OK thank you. There are 2 companies involved We haven't yet started a complaint agisnt the second one, as we were advised by the initial call to the Ombudsman service that we should pursue a claim against the first company.

Its unlikely that a court will side with you if both the adjudicator and the Ombudsman have not held up your complaint. The Ombudsman is neutral and is held in a good legal standing.

I know they won't sid ewith us, although reading through the transcripts of the calls, which i made, it does seem like we were right to pursue it. Feel very very let down by the system
