Non transferable warranty on house conservatory? Confused.

I wonder if anyone can help with a quick question.

We bought a house with a newly constructed (and very expensive) conservatory in 2006. We have copies of the paperwork for the construction. The company in question advertises 10 year warranties in lots of mags and on their website (www.amdega.co.uk/guarantee.asp). It?s leaking in several places. I called and asked for a warranty call out, they said ?warranties are non-transferrable?.

I?m considering my options including the mortgage lender's surveyor and / or trying my building insurance policy but wondered what you think I could / should say to Amdega?

I'm afraid their liability is only to the original purchaser of the conservatory. You don't have any contractual relationship with Amdega. If you have a claim at all, it is either against the people who sold the house to you (unlikely) or the surveyor (if this was the kind of fault that should have been detected by the survey for which you paid). You may, of course, be able to claim against your building insurance.

If you are still in contact with the people who sold the house to you, you may be able to get them to call out Amdega. Without seeing the full terms and conditions I don't know if this would work.
