Hi, hope someone can help. Do you automatically qualify for legal aid if you have no income?

Thanks

Depends on savings and assets too iirc.

blondemummy · 09/02/2010 10:22

I only have about £500 quid savings and no assets.

what do you live off??

GypsyMoth · 09/02/2010 10:30

think you need to be claiming one of the 'gateway' benefits...

blondemummy · 09/02/2010 10:42

Sorry I should have said. I don't have to live off that. I'm seeing a solicitor on Thursday to talk about divorcing my husband. He earns a salary and has savings in his name but I presume this doesn't make any difference to whether I will get help?

You may find that they take your husband's income and assets into account, even if not currently in joint names. Do you co-own a house, car etc ?

blondemummy · 10/02/2010 09:42

The house is in both our names. If they take his income etc into account then thats I'm screwed. I can't afford to pay any legal fees. I haven't got much money of my own. Have to see what tomorrow brings then I guess.

You might be able to pay them out of any settlement, in stages.

Sassa · 13/02/2010 20:54

Hi

Your husband's income and savings will be ignored as 'assets in dispute' so if all you have is £500 in savings and no income, you should qualify.

Best regards
