How do I get builder to take responsibility?

Long story,but loft conversion has just been a nightmare from start to finish.. but I have been told by the boss that we "have moaned about everything" That's his attitude.
I have fallen down the stairs,my son has badly scratched himself on screw sticking out. They failed to cover up fireplaces and a huge amount of thick black soot came out and they won't take the clear up seriously. My husband has asthma and now DS is poorly with bad cough. They are completely ignoring basic safety issues I think. Also, they have been smoking in my house. Who can I turn to? Any legal leg to stand on? Anyone?

you can go to citzen advice and take them to court you need to take pictures of the health and safety risks that are not being dealt with. get medical reports for your husband and ds record as due to lack of care and attention ds may now have bad health like daddy due to them not being careful , if you seeked medical help when you fell you need reports and pictures or injures and you need to get a council health and safety worker out to do report against them as they seem to be failing building regulations.

yeah, but what am I sueing them for? What's the charge.Negligence? I really don't want to go to court, but I do want to threaten them, just so they take me seriously.

Are they a member of any trade organisation? If so I would speak to builder regarding contacting them, if not then I would recommend speaking to building control at your local council.

have they finished it? if not i would sack them. if its not going well and you uncomfortable with them in your house i would find another building firm.

Who is doing the periodic inspection? When we got our loft converted, there was a company who signed off the work, and I mentioned to them that there were sockets with live electricity and didn't appreciate it, they immediately were tidier, cleaner and didn't, um, take the piss. At least not as much.

have spoken to 2 trade orgs they are with, and am going to make an official complaint. Have also sent my lawyer the details, he's not got back to me yet, but that will probably cost a fortune.
No contact with boss or foreman since Sat, and no response to my detailed email on Mon morning.but the guys are turning up and doing the job well. Different teams for different jobs, the plasterers have been here this week and cleaned up well, but that's cos I was able to ask them to cos they speak English. He actually said to me, yes you need to be careful cos of the little boy.
they have nearly finished, and we haven't paid them anything for 2 weeks. We haven't refused, but they haven't asked, so we are probably well ahead there.
