Situation in brief:
Friend is divorcing due to his unreasonable behaviour including his gambling......
Friend in rented for nearly a year with dc(he wouldn't leave) but is wanting the marital home. She doesn't work (young dc) he won't pay maintenance and is self employed/illegally claiming JSA (angry) to get mortgage paid etc - probably not relevent but gives you a taste of what this guy is like.
Some equity in marital home, 50k jointly owned compensation sat on hold due to divorce
They sorted out debts 18 mnths ago and have been on a payment plan individually since they split a year ago.
Since split he has ran up another £14k of debt with Tesco (he had previously ran up around £50k of debt on credit cards) and they are now wanting to put a charge on the house. The tax man is after him for money too. His solicitor is wanting £3k for their fees from the compensation money - go swing is my initial thought.
Back to the marital home:
Is her share safe from his creditors?
Can Tesco put a charge on the house that will force it to be sold?
Have no idea how he managed to get a credit card from them under the circumstances?
Any help/info to give her an idea before she speaks to her solicitor much appreciated!
