Not sure if I have posted this in the right area or not so apologies if i havent. Question - if one goes through traffic lights on green, turns left into a dual carriage way but goes in the right hand lane( because traffic queued up in left lane), then someone hits you from behind.....it is the driver who hit you that is responsible isn't it as they hit you?

yes, as far as I'm aware it is their fault

I think so, if you are hit from behind, I'm pretty sure it is their fault. Also if your lights were green, then where were they coming from anyway? Surely they jumped a light?

Thanks, its actually a colleague of mine that was hit....her insurers are saying she is at fault as she entered the dual carriage way (they suggest she drove without due care an attention) She is arguing with them saying she went through on green from the side road and surely it must be the other drivers fault and that he must have gone trough on red. I have said to stand her ground as she was already on the carriage way when the other person hit her and suggested she see a solicitor.
