I think I will have to speak to a lawyer about this but looking for any advice meantime. I will try to just give the facts.
Maternity leave ended September last year, I had informed employer that I would not be returning to work..no issue there. I had previously signed up for a computer for employees scheme costing £35 out my wage each month, my employer explained that they could not take the payments out of my maternity pay so suspended payments. I knew that I would have a lump sum to pay at the end of my employment. I received my last pay in September (they never sent a wage slip) I knew I was due some holiday pay etc so just (naively) assumed the holiday pay was paid and the amount owing for the computer had been taken..it was a low wage anyway........I stupidly never thought about it or looked into it to make sure everything was right. Then in October I received another payment (£700) I was on holiday at the time and assumed I had more holiday pay than I had expected and didnt question it, just celebrated a good wage . I never received a payslip just a letter sent a few weeks later stating I was paid after my employment had ended so they were writing to the tax office to let them know. Then in December I received a letter from a debt recovery agency saying I owed the company £840 for the computer scheme. I dont work (sahm) and have no income of my own and coming up to xmas I ignored them (I was angry that no-one had been in touch to say made mistake offer repayment terms etc etc) I received another letter in March basically saying the same, which I ignored ......then yesterday a baliff turned up at the door (I am in Scotland) I said I was disputing it and he just handed me a letter and said he will tell the company to proceed with going to court.
So my question is where do I stand with this.....I dont have an income...I would be happy for them to take the computer but its only worth about £200 now I would think. Any advice.........apart from 'its your fault for not looking into the payments'
