costs -- small claims court

Am going to small claims court tomorrow.

What are the rules in reference to costs (assuming the judge rules in favor...)

I beleive you get all the court fees for initial claim, allocations etc back.

If you have expert witness costs, such as (in my case for example) building experts, you can claim an amount back which is capped at a level around £250 per witness?

If you are wanting other costs, such as travel, photocopying etc, i think you need to include this is the cost you are claiming back as a total figure.

Oh I think you can claim back solicitors fees too, but again i think they are capped at a top level.

Firstly there's no such thing as the small claims court. It's the normal County court that handles small claims.

Thanks. DP was supposed to work an over time shift tomorrow, but has to come to court with me as a witness, and as you can imagine, is not thrilled. His employer wrote a letter saying that he would have been asked to work, so am hoping this may be recoverable?

Oh maybe. I think you can at least ask for it, I don't think you will be penalised for asking for it, with evidence, and the judge will make a decision. It is, in essence 'loss of earnings' isn't it?

Wow that is absolutely fab ILMD. I am so pleased for you. My sub has run out, can you CAT me and I will respond. Would love to hear your experience was. Do you stand any chance of getting the money owed back, as in will the builder financially be able to pay? (was a company wasn't it?).
