Family Court HELP DV

Hoping someone can offer advice. I will try to make this as coherent but also as concise as possible .

I was in an abusive relationship from late 2021 until last October. There were multiple rapes , including anal rape and these were violent , not a case of "I didn't say no" I was begging and crying and was beaten about the head until my ears were ringing. There were many physical assaults resulting in a fractured sternum and ribs and a bruised spleen , in addition to bruising from strangulation, black eyes and split lips etc. Generic bruises from regular beatings.

He was also abusive to my older 2 teenage children but had us terrified that if we ever reported , things would get worse. He was never physical towards them but he would say disgusting and degrading sexual things to them such as my daughter would end up like her mother and a slag basically (worse terms than this). He said things about my son I just can't put onto here but I will in my CAFCASS interview. My son was growing his own fruit and veg , my ex urinated over it all.

Honestly I could go on and on but I have to keep it short ; I just need to get across the picture of how horrific it was. He locked me both in and out of the house , one time when I was held hostage I tried to make an escape , he dragged me up the stairs by my hair and threatened to shave it all off leaving me "looking like a cancer patient"

He lead us to believe he had criminal associates and knew people within the police force who he could pay to rape my children and set fire to both my home and my ex-husbands that he shares with his wife and 2 small daughters. He also said he would have me arrested and put in prison for benefit fraud for money claimed whilst he lived with us (never mind the fact we didn't want him there).

In 2024 , I called police from my sons phone after he had once again taken mine from me and deleted any evidence of injuries sustained (he always did this and then also deleted from my recycle bin - one time even factory resetting my phone. He would also message other men pretending to be me and we live in a small town - it was just humiliating and I was so trapped left with absolutely nobody). Anyway , he had left the home with my phone and I called the police. They arrived and I blurted out everything he had ever done . I thought even if any of this is true about him knowing people there has to be someone who can protect my children because this is no way to live . He was arrested and held on remand refused bail. His father however paid for a solicitor and he did get bailed after 2 weeks . He broke bail immediately to tell me he had met people in prison and that I had to drop the charges or things would get worse . His charges were counts of rape, intentional strangulation, threats to kill, GBH, cohersive and controlling behaviour.

Quick caveat - I really am trying to keep this short- he did have a burner phone. Very early on when I was accused of sleeping with some young lad from the town , he told me he had arranged for him to be attacked but if I cut contact with everyone from the local pub he would put a stop to it. This was just a kid , he can't have been more than 20. My ex appeared to call off this arrangement and I did hear someone on the other end of the phone so I don't know how true it is ! He said they wanted £500 because they had already driven from their shift to our town. I just do not know what's real, even now. He said if I ever got a restraining order he would come back and bury us all.

I called CPS and begged for charges to be dropped and they said it was too serious and would go ahead as victimless. I was so convinced we were all going to die. I refused access to my medical records and nobody gave video evidence so eventually it was NFA without going to court - stating my mental health as the reason.

Once he was out everything ramped up. The abuse was horrific and I became pregnant within weeks. I could not terminate as I did not have access to a car. My son was born in late August (early because I was in hospital with my blood pressure for 6 weeks prior). Pregnancy was awful and post-partum was awful. My son was in the NICU and obviously once he was here I adore him. I was assaulted once we got home and whilst still bleeding from childbirth.

When the baby was 6 weeks old , I saw on facebook a woman had found out her husband had cheated by a secret whatsapp chat where it is hidden and you have to use a fingerprint to access it. This set in motion the final escape plan. I started to record things and send them to myself then delete them from my phone. The final incident was him accusing us all of stealing his phone , smashing the house up and threatening to take the baby away from me ( all recorded). I called the police. The whole time he was holding the baby I just thought as soon as I get him back he is never leaving my side. My ex was in the background telling the call handler that I had post partum psychosis and had trashed my own home. They passed this info onto my health visitor after visiting. I calmly told him after he left for work the next day that I had evidence and was willing to use it. He disappeared . For almost a year.

I booked a holiday in April and realised I needed permission from his father so I contacted both a local DV charity and a family law solicitor who applied for legal aid but it was rejected on merit because he is absent and nothing to suggest he would contest. I wanted permission for the holiday and a name change (my son has the exact same first and surname as his father but we refer to him by his middle name) . As this was rejected , I went ahead and filed c100 and c1A for those and also for a child arrangements order. I didn't want to do this really because I don't want to remind him that we exist , incase it angers him . But my local harm reduction hub reassured me measures would be put in place.

Last Sunday I got a phone call from a number I didn't recognise . It was him demanding to see his son. I could add more here but trying desperately to keep it shorter. I was shaking , teeth chattering , throwing up just mad panic at hearing his voice. I assumed he was on his way over as he sounded like he was in a car. He wasn't and we haven't seen him.

I guess after all of this my question is .... surely to God please please tell me it is not likely he will get contact ? even in a contact centre ? my son only knows myself and his brother and sister. He won't understand being left in a room with a man he doesn't know. I cannot access therapy because I don't have a support network anymore or childcare. I have to try and parent my best until he is in school. My reaction to one phone call was horrific and I thought I was on my way to being healed. I am terrified , my children are in weekly therapy and as a family we are trying to heal.

The email I received was dated thursday but I only got it today. It was sent elsewhere first and asking "the applicant" which is me to do a list of things which included providing them with a statement but I really wasn't entirely sure if they wanted specific details of what. I go on holiday on Sunday (uk break) for a week just me and the children and I keep trying to park this and relax.

This is what I replied
To whom it may concern

I do not know the respondents home address but I believe him to have no fixed abode. I was contacted 2 weeks ago on telephone number 07xxxxx this was the respondent calling me. The address given on my sons birth certificate is bla bla and postcode. I contacted the propertier of this premesis and she is an elderly lady who has barred him from the pub for his behaviour and believes he is seeking support from homeless charities. I was also told he is employed at xxx on their xxx site.

Previous to this , I had reached out to both an old number and to family members ; all of whom , including parents, siblings and cousins , wish to not be involved in his life nor do they have any inclination of his whereabouts.

I have significant safety concerns about continuing my search or contacting any other known associates; especially given the recent contact and it's impact .

Please could the court advise what evidence is required or if an alternative method of service might be more appropriate in these circumstances?

I do wish to co-operate with the court and it's proceedings whilst also maintaining safety for myself and my family.

@Goldenmimx So now I just wait some more. If they do find a way to serve him and he ignores then it will proceed without him ? That sounds like the absolute best outcome.

This reads really well. It demonstrates you’ve gone above and beyond- despite his behaviour that you’re showing yourself to be reasonable. I think a court would be satisfied you’ve used all your best endeavours to locate him. All of that must have been stressful to you but well done.
so yes, it just seems like more waiting for you now. If the court is satisfied you’ve done what you can to assist in him being given the opportunity to engage (and I think they will) and he doesn’t, they will just hear your application without his input. Hopefully you can relax on your break without this playing on your mind

Goldenmimx · 19/10/2026 22:02

To be honest, it makes me so cross that you, as a victim of quite heinous Domestic Abuse are expected to go to such lengths to give him the chance to object to your application. The system seems like a joke sometimes, especially when it comes to protecting women

childrenaremyworld · 19/10/2026 23:08

I’m so sorry you and your children are going through this, you are a wonderful and strong mum and so very brave. Three years ago my exh was arrested for dv. I applied for a non molestation order and occupation order (which I did get). I had the same problem though as the court were not able to get in touch with exh, despite sending him emails and messages to his phone. He likely did receive them but did not open up the messages, so the court could not proceed as he had not been ‘served notice’ I had to attend court four times before the judge eventually agreed to the orders even though they were not able to notify exh. Please keep persevering and don’t give up. My son was sixteen at the time also, it really affected him. I persuaded him to have counselling and he has turned the corner. I think you said in your previous post the eldest two are having counselling.

Do you also have a DV worker and social worker? Once a police report is made they are assigned to help you.

Also if possible can you relocate? So your ex doesn’t know where you live? The police can also put a marker on your house. Also to keep you safe and provide evidence if needed invest in a ring doorbell.

You can contact NCDV for advice on the court process and also please get in touch with women’s aid for further advice, on visitation rights. Hopefully he will not contest. My children refused to see exh. They were 10 and 16. The social worker said he would need to take legal action and process through court for visitation rights. Luckily he did not, hopefully you ex will not go through this lengthy and costly process. Your doing amazing to have come so far xxx

childrenaremyworld · 19/10/2026 23:17

Just to add if you contact NCDV they will take a statement from you over the phone and send it directly to the court. If you can break it all down into sections with rough time lines before you contact them to help with your statement. Keep strong, you can do this xx

Namechange2028 · 20/10/2026 06:30

@Goldenmimx it really is a joke isn't it and I honestly think this is the reason I am worried he will be given contact if he ever does show his face.
@childrenaremyworld I am so sorry you went through DV and that your children were affected but having to go to court so many times before they agree to the orders just seems so incredibly stressful for you after what you and the children have already been through . They really shouldn't make it so difficult. So glad you are safe and well now.
I do have an IDVA yes . I am in social housing too and I contacted their domestic abuse team and have had a ring doorbell fitted (well blink but same thing) , my doors replaced (he had broken in enough times to permanently damage front and back door), and alarms are installed for my windows too.

In terms of moving , my daughter has 2 years left in school so we actually are fully intending on leaving once she is done. But my previous idva did say we could get something called a "managed move" if we wanted. So he didn't know where we are. I wanted to wait until she was done with school though. I know I will feel so much better when we are moved .

I did send a chronology to the court which was a lose sort of description of the abuse from start to the finish when he left last october. The Idva and her manager came to the house to helo me write it for my legal aid application that got rejected so I sent it with my c100 and c1a.

Ugh ok so the google AI thing says I was asked to format it as a statement and gave me another layout with dates of when he contacted me rather than just saying 2 weeks ago. So because I have already sent it ... I will have to resend I think. I actually have no fucking clue what I am doing and it's very stressful. Google also said about asking for a c4 ? Where they track him through dvla and hmrc.

OP posts:
Goldenmimx · 20/10/2026 13:54

It is definitely beneficial to have dates but don’t worry too much. The court will know you’re a litigant in person and what you put together was informative and clear. I think if you look at the family procedure rules (they’re on justice.gov.uk) part 22 deals with evidence for the family court. Hopefully by the time you need to give a substantive statement your Legal Aid will be in place.
As for the C4… again not a family lawyer so not completely au fait with it without looking it up. However I just wonder if it would be better to hold on and see what the court says after considering your statement. It’ll be another court fee to do that application. Plus if he’s homeless is it likely to actually come up with anything?! The court can direct further steps to engage him if it sees fit

Namechange2028 · 20/10/2026 20:39

I did end up writing it up as a formal statement with screenshots attached as a pdf . Separated it into the things they had specifically asked for so family and associates, social media, employers and I can't remember what else but it asked for evidence of specific attempts. Then did a statement of truth thing at the end. I did stress both on the document itself and the covering email how risky this was to our safety. I said it at the beginning of each of my explanations for each attempt too. Like "despite the risk" and then continued on haha. I did try not to sound like I am not co-operating with the court and there is a plethora of evidence attached. I then sent a separate email with URGENT asking if it was possible to dispense with service at any point because I really didn't feel safe with the fact I've "poked the bear" so much. I obviously didn't use that wording but I do feel like this is just winding him up .

OP posts:
Goldenmimx · 20/10/2026 21:15

It sounds like you’ve done absolutely everything that can be expected of you and more. See what the court comes back with but I think it sounds like things are on your side

IndigoBabble · 20/10/2026 22:08

Sorry if I am repeating what has already been said. You need to push for legal aid and also for a fact finding re the domestic abuse if he has no relevant convictions to back up what you are saying. Don’t be pushed into agreeing any interim contact and try and push a section 7 report. I’m in the field and if you told me what you said in your post I would be advising the court of the above steps re fact finding and section 7 and advising no interim contact. Good luck

Namechange2028 · 21/10/2026 12:37

@IndigoBabble I tried again for legal aid and the solicitor said we can reapply if he does contest or respond/reply on the C7 form.
In terms of fact finding and section 7, we haven't even had the cafcass initial interview yet so obviously that is a way off. Nothing is happening until they either dispense with service or find another way to locate him and make sure he knows of the hearing. We don't even have a hearing date for the first one yet. It is moving incredibly slowly due to him being awol. But christ I would bloody hope that's what is recommended to the court.

@Goldenmimx I really do hope things are on my side.

You need to push for this in your Cafcass interview. Say you feel it is needed. Good luck.
