Family Court HELP DV

Hoping someone can offer advice. I will try to make this as coherent but also as concise as possible .

I was in an abusive relationship from late 2021 until last October. There were multiple rapes , including anal rape and these were violent , not a case of "I didn't say no" I was begging and crying and was beaten about the head until my ears were ringing. There were many physical assaults resulting in a fractured sternum and ribs and a bruised spleen , in addition to bruising from strangulation, black eyes and split lips etc. Generic bruises from regular beatings.

He was also abusive to my older 2 teenage children but had us terrified that if we ever reported , things would get worse. He was never physical towards them but he would say disgusting and degrading sexual things to them such as my daughter would end up like her mother and a slag basically (worse terms than this). He said things about my son I just can't put onto here but I will in my CAFCASS interview. My son was growing his own fruit and veg , my ex urinated over it all.

Honestly I could go on and on but I have to keep it short ; I just need to get across the picture of how horrific it was. He locked me both in and out of the house , one time when I was held hostage I tried to make an escape , he dragged me up the stairs by my hair and threatened to shave it all off leaving me "looking like a cancer patient"

He lead us to believe he had criminal associates and knew people within the police force who he could pay to rape my children and set fire to both my home and my ex-husbands that he shares with his wife and 2 small daughters. He also said he would have me arrested and put in prison for benefit fraud for money claimed whilst he lived with us (never mind the fact we didn't want him there).

In 2024 , I called police from my sons phone after he had once again taken mine from me and deleted any evidence of injuries sustained (he always did this and then also deleted from my recycle bin - one time even factory resetting my phone. He would also message other men pretending to be me and we live in a small town - it was just humiliating and I was so trapped left with absolutely nobody). Anyway , he had left the home with my phone and I called the police. They arrived and I blurted out everything he had ever done . I thought even if any of this is true about him knowing people there has to be someone who can protect my children because this is no way to live . He was arrested and held on remand refused bail. His father however paid for a solicitor and he did get bailed after 2 weeks . He broke bail immediately to tell me he had met people in prison and that I had to drop the charges or things would get worse . His charges were counts of rape, intentional strangulation, threats to kill, GBH, cohersive and controlling behaviour.

Quick caveat - I really am trying to keep this short- he did have a burner phone. Very early on when I was accused of sleeping with some young lad from the town , he told me he had arranged for him to be attacked but if I cut contact with everyone from the local pub he would put a stop to it. This was just a kid , he can't have been more than 20. My ex appeared to call off this arrangement and I did hear someone on the other end of the phone so I don't know how true it is ! He said they wanted £500 because they had already driven from their shift to our town. I just do not know what's real, even now. He said if I ever got a restraining order he would come back and bury us all.

I called CPS and begged for charges to be dropped and they said it was too serious and would go ahead as victimless. I was so convinced we were all going to die. I refused access to my medical records and nobody gave video evidence so eventually it was NFA without going to court - stating my mental health as the reason.

Once he was out everything ramped up. The abuse was horrific and I became pregnant within weeks. I could not terminate as I did not have access to a car. My son was born in late August (early because I was in hospital with my blood pressure for 6 weeks prior). Pregnancy was awful and post-partum was awful. My son was in the NICU and obviously once he was here I adore him. I was assaulted once we got home and whilst still bleeding from childbirth.

When the baby was 6 weeks old , I saw on facebook a woman had found out her husband had cheated by a secret whatsapp chat where it is hidden and you have to use a fingerprint to access it. This set in motion the final escape plan. I started to record things and send them to myself then delete them from my phone. The final incident was him accusing us all of stealing his phone , smashing the house up and threatening to take the baby away from me ( all recorded). I called the police. The whole time he was holding the baby I just thought as soon as I get him back he is never leaving my side. My ex was in the background telling the call handler that I had post partum psychosis and had trashed my own home. They passed this info onto my health visitor after visiting. I calmly told him after he left for work the next day that I had evidence and was willing to use it. He disappeared . For almost a year.

I booked a holiday in April and realised I needed permission from his father so I contacted both a local DV charity and a family law solicitor who applied for legal aid but it was rejected on merit because he is absent and nothing to suggest he would contest. I wanted permission for the holiday and a name change (my son has the exact same first and surname as his father but we refer to him by his middle name) . As this was rejected , I went ahead and filed c100 and c1A for those and also for a child arrangements order. I didn't want to do this really because I don't want to remind him that we exist , incase it angers him . But my local harm reduction hub reassured me measures would be put in place.

Last Sunday I got a phone call from a number I didn't recognise . It was him demanding to see his son. I could add more here but trying desperately to keep it shorter. I was shaking , teeth chattering , throwing up just mad panic at hearing his voice. I assumed he was on his way over as he sounded like he was in a car. He wasn't and we haven't seen him.

I guess after all of this my question is .... surely to God please please tell me it is not likely he will get contact ? even in a contact centre ? my son only knows myself and his brother and sister. He won't understand being left in a room with a man he doesn't know. I cannot access therapy because I don't have a support network anymore or childcare. I have to try and parent my best until he is in school. My reaction to one phone call was horrific and I thought I was on my way to being healed. I am terrified , my children are in weekly therapy and as a family we are trying to heal.

Oh my fucking god I found a family law facebook group support thing and the stories make me feel sick. One woman has had cafcass and social services demanding no direct contact and the judge ignored it and told her his word is final. Which is true. Legally. There are so many stories of father's getting contact and its making me heave. This is with evidence of abuse and a section 7 done. I just posted on there very briefly because I can't type this whole thing out again but I have said he was abusive please tell me people have succeeded with no direct contact.

I’m sorry OP, it all must be very worrying for you. I think for your own sanity though you can’t go down the rabbit hole of looking at all those worse case scenarios. And I’d be very surprised if a Judge disagreed with social services’ input. And there is still the chance in your case that he either doesn’t engage or even if contact is granted that he just loses interest very quickly

Sunflower07 · 13/10/2026 22:39

Firstly, I am so sorry to hear what you and your children have been through. If your ex responds to the application and wants contact, can you reapply for legal aid at that point?

there has been a recent change in family law in that there is no longer a starting presumption that contact with both parents is best for the child. Your argument as to why there should be no contact would need to link back to this, and highlight in your statement the emotional impact of this man’s behaviour on your older children, his disregard for their wellbeing and risk of this transferring to your youngest son in the event there is contact. I would also highlight the impact this man’s actions have had on you and the risk to your wellbeing if contact goes ahead.

would his mum support you in proceedings, such as providing a statement of her own?

make sure you check / request that his police history is obtained. If ex partners have had restraining orders then it’ll flag up. In your statement I’d say something like ‘Mr XXX has a history of domestic abuse spanning XXX years across (number of) relationships. Such suggests an ongoing pattern of harm towards others. I am concerned there would be a risk to (child)’s emotional wellbeing and development through exposure to domestic abuse, in the event that direct contact occurs.’

happy to help you further if I can (this is my area of work)

Namechange2028 · 14/10/2026 08:04

@Goldenmimx this is true isn't it , he could still just not respond. I don't know if to chase up and ask the court if there is a date set for the first hearing or sit and wait.

@Sunflower07 I saw an article regarding the change but in practice I don't know that it's making a difference . Similarly to this PD12J whatever thing is ; there are mixed reviews on if this is being adhered to.

Yes I think they will do a police check initially and his wife did get a restraining order and took him to criminal court but he was found not guilty ; again his father funded a solicitor for that. I submitted a clares law myself before the c100 application and they said there's nothing .. the only one thing on there DV related he was found not guilty for. And I am there thinking wow he is an absolute monster and they're saying there is nothing. My IDVA gave more info than the clares law did and she could see the actual charges were threats to damage property , sending obscene and threatening messages and I can't remember the rest but she got a non mol for 12 months on him.

@Sunflower07 yes help with the statement would be amazing.

Namechange2028 · 14/10/2026 14:18

Does anyone know who pays for the contact centre? Saw another post (not doing well on avoiding the rabbit hole sorry) proven dv and the woman has been ordered to pay 1/3 of the cost. This is insane out there.

OP posts:
Sunflower07 · 14/10/2026 14:32

Honestly Clare’s Law is not used properly by a lot of the police forces I’ve come across. It’s dreadful but DV is very much bottom priority unfortunately.

Family court is a different burden of proof than criminal. So even tho he was found not guilty at criminal trial, does not mean family court will ignore or dismiss those concerns. That’s why if you can get statements from others who are aware of his behaviour, it may help your case.

re contact centre funding, it is usually the NRP who pays unless ordered otherwise by the Court.

I know it’s easier said than done, but try not to spiral about the what ifs. He might not even respond formally to your application. But of course it is still good to be prepared in case he does!

Daisychain700 · 14/10/2026 15:09

very quick message. So sorry what you’ve been through and stay strong.
get off that Facebook group is my advice, it’s more scary than anything reading the stories. Most helpful thing for me was the milk exchange.
trauma informed support for people who’ve experienced DV going through court. You can find contact details online.

Namechange2028 · 14/10/2026 16:09

Yeah its the 51% mentioned earlier ? In terms of the burden of proof . But the other charges that his wife filed they aren't about me or my son. I feel like they'll mostly be focused on the child . But I have no idea really as never done this before.

I absolutely need to get off the facebook page because it's making me ill. We were doing so well as a wee team putting our lives back together.

Never heard of the milk exchange i will look into it.

He refuses to divorce his wife too , she is trying to get remarried and has paid court baillifs or whatever to serve him because he keeps ignoring. This is years and years later . He just wants control of everyone all the time.

OP posts:
Goldenmimx · 14/10/2026 21:45

The focus will be on your child absolutely but the detail about him doing this to an ex as well is relevant because it paints a full picture of what he’s like. That goes towards the question of whether he is safe to be around your son.
if you must go on the Facebook page maybe just try to limit the time that you do because it will just cause you to spiral and you need your mental strength to focus on getting the right result for your child. I’d personally chase listings at the court just to see if they’ve processed your application. Courts can take a time issuing applications but no harm in asking. Thats promising what the PP said about a shift away from the presumption of contact with both parents. I hope that provides some reassurance and I’m glad someone working in Family law has offered their input

Namechange2028 · 15/10/2026 08:20

I don't want to annoy anyone with asking for an update . I think they issued it 6th October. That's when I got an email after chasing it up asking what the progress was since I had submitted 29th September.

But the wait is killing me not knowing when the hearing will be or anything. Or if he has managed to have been served.

I have a call with my idva at 10am .

OP posts:
Goldenmimx · 15/10/2026 10:42

Hope it went well. Don’t worry about bothering the Court- they’re used to it. I’d probably give it to the end of next week to chase based on when you issued. Some courts are quicker at processing applications than others

Namechange2028 · 15/10/2026 12:04

@Goldenmimx we go on holiday 26th October. Would you suggest calling the Friday before we go on the Monday to chase up ? I have had a complete panic attack today after the idva call. Honestly appreciate all the advice in here to keep me going.

OP posts:
Goldenmimx · 15/10/2026 12:09

I wouldn’t call to be honest- I think it’s similar to the County Court where you get put through to a national helpdesk number and they’re anything other than helpful. You’ll wait ages to speak to someone and they’ll tell you they can’t tell you anything without a claim number. Which you won’t have given that the papers won’t have been issued. I’d email- details will be on Govt website Find a Court or Tribunal. And I’d send it on the Friday.

was the IDVA less than reassuring?

Namechange2028 · 15/10/2026 16:06

I do have a number. It has gone to the court passed admin people. It was issued and I got a number on 6th Oct. I have a case number if thats what you mean ?

OP posts:
Namechange2028 · 15/10/2026 16:07

I applied 29th September it was issued 6th october

OP posts:
Namechange2028 · 15/10/2026 16:55

Solicitor has said wait for cafcass interview, if he contests then we have grounds to reapply for legal aid.

OP posts:
Goldenmimx · 15/10/2026 18:52

Ah ok sorry I thought you’d submitted it but hadn’t heard back. Thats good that you have a direct number too and a plan at least in terms of applying for Legal Aid. It’ll all be ok OP, I suppose it’s just a case now of waiting and seeing

Namechange2028 · 15/10/2026 19:48

I submitted 29th September and I chased it up a few days ago and was told it was issued 6th october. That's why I didnt want to chase again to ask about an update incase it was pestering.
Thank you. We are on holiday for the half term and I don't want to be having this in the back of my mind the whole time.
Would the court ask him to do drug and alcohol testing with his addiction history? I feel like he would fail everything and not fund a contact centre anyway even if he got it. I really hope when it comes to the end of all this i look back and think why was I so hysterical.

OP posts:
Ra33it99 · 15/10/2026 20:09

They may ask for drug and alcohol testing if they think it's proportionate. It'll depend on the wider issues.

You need to make everything about the impact on your child. The abuse you suffered is awful but it's the impact on the children the court will care about. Your son is too little to have his wishes recorded but you can say to Cafcass etc. that his older children don't want a relationship. Welfare of the child is paramount.

For the hearing itself, you can request separate waiting rooms, screens, etc so you don't have to see him. And you can bring a McKenzie friend if you would find that helpful.

Ra33it99 · 15/10/2026 20:11

P.S. if he contests, I imagine you'll get a section 7 report request given the risk factors

Namechange2028 · 15/10/2026 20:46

The older children are not his. It was their father and their 2 siblings with his new wife that he threatened with these associates. & it is precisely the fact it will be child centred (the child in the application) that is causing me to have the concern he will get contact. There was one question in c1a regarding abduction and as I said, I do have recording of him threatening to take the baby.

I hear over and over again how family court has said "just because he was abusive to the mother doesn't mean he was to the child" but as far as I am aware with the PD12J updates my allegations of abuse have to be taken into consideration in the safeguarding assessment. I read somewhere in my rabbit hole too that children who are witness to DV are victims in their own right. All 3 of my children , including the baby have been present for a lot but everyone was there when he smashed the house up for his final hurrah. Yes my son was only 6 weeks old but he was present and his father took him from me whilst we waited for the police.

It is just so unnerving to think he could be given direct contact despite all of this. & the fact that I have proof of some of the injuries he inflicted on myself and all the police records before the baby was born , could potentially mean nothing as it is all about what he did to me and not the child.

Namechange2028 · 19/10/2026 13:06

I have had some correspondence this morning. I have to provide a statement and evidence that I have attempted to find his whereabouts ? Does that sound correct ? Because the court have been unable to find him. Failing that they'll close it i think ???

OP posts:
Goldenmimx · 19/10/2026 13:50

Sounds like something a Court could order, yes absolutely. So you say what reasonable attempts you’ve made to find where he is now so that he can be served. If the court is satisfied with those attempts and he still doesn’t attend/answer the application they’ll proceed in his absence

Namechange2028 · 19/10/2026 20:25

This is what I replied
To whom it may concern

I do not know the respondents home address but I believe him to have no fixed abode. I was contacted 2 weeks ago on telephone number 07xxxxx this was the respondent calling me. The address given on my sons birth certificate is bla bla and postcode. I contacted the propertier of this premesis and she is an elderly lady who has barred him from the pub for his behaviour and believes he is seeking support from homeless charities. I was also told he is employed at xxx on their xxx site.

Previous to this , I had reached out to both an old number and to family members ; all of whom , including parents, siblings and cousins , wish to not be involved in his life nor do they have any inclination of his whereabouts.

I have significant safety concerns about continuing my search or contacting any other known associates; especially given the recent contact and it's impact .

Please could the court advise what evidence is required or if an alternative method of service might be more appropriate in these circumstances?

I do wish to co-operate with the court and it's proceedings whilst also maintaining safety for myself and my family.

@Goldenmimx So now I just wait some more. If they do find a way to serve him and he ignores then it will proceed without him ? That sounds like the absolute best outcome.
